Overview

The Licence Area Plan – Nhulunbuy Radio, enacted in 1996, was introduced to regulate radio broadcasting services in the Nhulunbuy area of the Northern Territory. This plan was created under subsection 26(1) of the Broadcasting Services Act 1992, which aims to provide for the regulation of broadcasting services, including licensing and standards. The Australian Communications and Media Authority is the enacting body responsible for developing and administering this plan, ensuring that the broadcasting services in the Nhulunbuy area meet the required technical specifications and community needs. The plan outlines the availability of one community radio broadcasting service and one open narrowcasting service within the specified areas, providing technical details and transmitter specifications to ensure effective coverage and service delivery.

Scope and Application

The Licence Area Plan - Nhulunbuy Radio is a legislative instrument made under subsection 26(1) of the Broadcasting Services Act 1992, and it applies specifically to the radio broadcasting services in the Nhulunbuy area of the Northern Territory. The plan outlines the availability of one community radio broadcasting service and one open narrowcasting service within the defined licence areas, detailing their characteristics and technical specifications. The geographic scope of the Act is confined to the Northern Territory, specifically the Nhulunbuy and Yirrkala areas. The plan was first determined by the Australian Broadcasting Authority on 27 August 1996, with subsequent variations in 2013 and 2017 that amended certain technical specifications and areas of service. The compiled law, as of 30 September 2017, includes all amendments up to that date, with uncommenced amendments accessible on the Federal Register of Legislation. The application, saving, and transitional provisions for the provisions and amendments are detailed in the endnotes of the compilation. Modifications to the compiled law by other laws are noted, but the text of the compiled law remains unchanged. This legislative instrument does not explicitly mention exclusions, exemptions, or thresholds.

Key Provisions

The Licence Area Plan – Nhulunbuy Radio sets out the requirements for radio broadcasting services in the Nhulunbuy and Yirrkala areas of the Northern Territory. According to clause 1(1), this plan is made under subsection 26(1) of the Broadcasting Services Act 1992. The plan specifies that one community radio broadcasting service and one open narrowcasting service must be available in the Nhulunbuy area, while one community radio broadcasting service must be available in the Yirrkala area (clauses 1(2) and 1(3)). The technical specifications for these services are detailed in Schedules One and Two, as well as in Attachments 1.1 to 1.3 and 2.1 to 2.2 to the plan. The Act imposes several obligations on the parties or entities it governs. Licence holders must ensure that their services comply with the technical specifications outlined in the Licence Area Plan, including frequency, transmitter locations, and emission parameters (Schedules One and Two, Attachments 1.1 to 1.3 and 2.1 to 2.2). Licence holders are also required to maintain their services in accordance with the Broadcasting Services Act 1992 and any other relevant legislation. Failure to comply with the technical specifications or other obligations may result in enforcement actions by the Australian Communications and Media Authority (ACMA). There are no specific offences or penalties outlined in the Licence Area Plan itself. However, breaches of the Broadcasting Services Act 1992 or other relevant legislation may result in civil or criminal penalties, including fines and imprisonment. The specific penalties depend on the nature and severity of the breach, as well as any relevant case law or regulatory guidelines. In general, serious breaches of broadcasting regulations may result in significant fines and even imprisonment for individuals, while corporations may face even higher fines. It is important for licence holders to be aware of their obligations under the Act and to take steps to ensure compliance to avoid potential penalties.
