Overview

The Broadcasting Services Act 1992 was enacted to regulate the provision of broadcasting services in Australia, ensuring that broadcasting services are provided efficiently and effectively, and that there is a diversity of content available to the public. This Act was introduced to address the need for a comprehensive regulatory framework that could accommodate the evolving landscape of broadcasting technologies and services. The Licence Area Plan for Mildura/Sunraysia Television – No.1 of 2010 was made under this Act by the Australian Communications and Media Authority, aiming to provide a detailed plan for the availability and technical specifications of television broadcasting services in the Mildura/Sunraysia area of Victoria and New South Wales. The policy objective of this legislative instrument is to ensure that the specified broadcasting services are available in the designated area with the appropriate technical standards, thereby facilitating the delivery of diverse and quality broadcasting content to the communities in the Mildura/Sunraysia region.

Scope and Application

The Licence Area Plan for Mildura/Sunraysia Television and Radio, made under the Broadcasting Services Act 1992, applies to the Mildura/Sunraysia region which spans parts of Victoria and New South Wales. It specifies the broadcasting services, including national, community, and commercial television broadcasting services, to be available in this area, along with their technical specifications. The plan details the allocation of service licence numbers for commercial and community services, the number of transmitters required, and the technical specifications for each transmitter, including transmitter sites, frequencies, and radiation patterns. The plan also sets out the geographic coverage of each transmitter. While the Broadcasting Services Act 1992 generally requires service licences for commercial and community services, the plan itself does not explicitly state exclusions, exemptions, or thresholds. However, the plan has been subject to amendments and variations over time, which may affect its application and the details provided within the schedules and attachments.

Key Provisions

The Licence Area Plan for Mildura/Sunraysia Television – No.1 of 2010, made under the Broadcasting Services Act 1992, specifies the availability of television broadcasting services in the Mildura/Sunraysia region of Victoria and New South Wales. It mandates that one national or community television broadcasting service, two national television broadcasting services, and two commercial television broadcasting services be available in the designated area, as detailed in Attachment 1.1. The technical specifications for these services, including transmitter details, are outlined in Schedule One and Attachments 1.1 to 1.6. Each Schedule lists the category of service, the service licence number (if applicable), the number of transmitters required, and the technical specifications for each transmitter, along with the general area each transmitter serves. Entities operating within this licence area must adhere to the technical specifications and service categories outlined in the Plan. This includes ensuring their transmitters comply with the designated frequency bands, modes, polarisation, and output radiation patterns as specified. Service providers must also ensure that their operations align with the broadcasting services bands and adhere to the technical planning guidelines referenced in the Plan. Any alterations to the transmitter specifications or operational parameters must be approved by the relevant authorities. Breaches of the Licence Area Plan for Mildura/Sunraysia Television – No.1 of 2010 may result in significant legal consequences. The Broadcasting Services Act 1992 provides for both civil and criminal penalties for non-compliance. Civil penalties may include fines up to a substantial amount, as determined by the Act. Additionally, criminal offences may be charged against individuals or entities that persistently or seriously breach the provisions of the Plan, potentially leading to imprisonment. The exact penalties are stipulated within the Act and may vary based on the severity and frequency of the breach. Compliance with the technical and operational standards set forth in the Plan is crucial to avoid these penalties.
