Overview

The Licence Area Plan – Mandurah Radio, made under subsection 26(1) of the Broadcasting Services Act 1992, outlines the broadcasting services available in the Mandurah area of Western Australia. This plan was introduced to address the need for specific broadcasting technical planning to ensure efficient use of the radio frequency spectrum. The plan was enacted by the Australian Communications and Media Authority and updated in 2018 to incorporate changes in broadcasting services and technical specifications. The policy objective of this plan is to ensure that broadcasting services in the Mandurah area are available with appropriate technical specifications, thereby facilitating effective communication and information dissemination in the region. The plan details the availability of two commercial radio broadcasting services, one open narrowcasting radio broadcasting service, and one community radio service, each with specified technical characteristics and service areas.

Scope and Application

The Licence Area Plan – Mandurah Radio is a legislative instrument made under subsection 26(1) of the Broadcasting Services Act 1992, establishing the parameters for broadcasting services in the Mandurah area of Western Australia. This plan specifies the availability and technical specifications of two commercial radio broadcasting services, one open narrowcasting radio broadcasting service, and one community radio service in the designated Mandurah licence area. The plan outlines the technical specifications and transmission details for each service, including frequencies, transmitter locations, and emission parameters, as set out in the schedules and attachments to the plan. The plan applies to entities holding or seeking to hold broadcasting service licences in the specified area, and the services are to be provided within the defined geographic boundaries, as referenced in the Australian Bureau of Statistics census data. The plan does not explicitly state any exclusions or exemptions, but its application is contingent on compliance with the technical and operational standards outlined within the Broadcasting Services (Technical Planning) Guidelines 2017 and other relevant legislative instruments. The plan may be subject to further refinement or clarification through subordinate instruments issued by the Australian Communications and Media Authority.

Key Provisions

The Licence Area Plan for Mandurah Radio, made under the Broadcasting Services Act 1992, establishes the framework for the availability of broadcasting services in the Mandurah area of Western Australia. Section 2 of the plan mandates that two commercial radio broadcasting services and one open narrowcasting radio broadcasting service will be accessible within the specified area using designated broadcasting service bands. The technical specifications, including frequencies and transmitter locations, for these services are detailed in Schedule One and Attachments 1.1 to 1.4. Furthermore, section 3 of the plan requires that one community radio service be available within another specified area, with its technical specifications outlined in Schedule Two and Attachment 2.1 and 2.2. The plan imposes several obligations on the entities operating within the designated licence areas. Broadcasters must adhere to the technical specifications provided, such as the frequency and emission details, to ensure compliance with the plan. This includes maintaining specific carrier frequencies, output radiation patterns, and maximum effective radiated power levels as stipulated. Additionally, entities must comply with any special conditions outlined, such as not exceeding specified circularly polarised field strengths at all elevations. Breach of the terms of this Licence Area Plan may result in legal consequences. While the plan does not explicitly list offences, non-compliance with the Broadcasting Services Act 1992 or the plan itself could lead to enforcement actions by the Australian Communications and Media Authority (ACMA). Penalties for breaches of the Act can be substantial and may include fines and other sanctions. Specifically, under the Broadcasting Services Act 1992, significant fines can be imposed for non-compliance, with maximum penalties varying depending on the nature and severity of the breach. Therefore, adherence to the plan's stipulations is crucial to avoid potential legal ramifications.
