Overview

The Broadcasting Services Act 1992, enacted by the Commonwealth Parliament, addresses the regulation of broadcasting services in Australia, ensuring compliance with standards and addressing gaps in service coverage. This Act empowers the Australian Broadcasting Authority to vary licence area plans to improve broadcasting services and ensure efficient use of the radio spectrum. In March 2003, the Australian Broadcasting Authority varied the licence area plan for radio in Hobart, Tasmania, to adjust technical specifications for community radio services. The variation included changing the technical specifications for the community radio broadcasting service, with the removal of certain technical specifications and the addition of new ones to better serve the Hobart area. The authority's policy objective is to enhance the availability and quality of community radio services in Hobart, ensuring they meet the needs of the local community.

Scope and Application

The Australian Broadcasting Authority's Variation to Licence Area Plan – Hobart Radio - March 2003 applies to radio services within the Hobart region of Tasmania. Specifically, it concerns the technical specifications for community radio services, altering the licence area plan as determined in December 2001. The variation introduces new technical specifications and deletes existing ones, affecting the frequencies and transmitter locations for community radio services. The geographic reach of this Act is limited to the Hobart region in Tasmania, aligning with the specified licence area as defined by the Australian Bureau of Statistics. The variation does not extend to other regions or states, ensuring its application remains localised within the designated Hobart area. Notably, this Act does not explicitly state any exclusions, exemptions, or thresholds, implying that all community radio services within the specified area are subject to the changes outlined. The application and enforcement of this variation are further detailed through attachments and technical specifications provided in the instrument.

Key Provisions

The legislative instrument, issued by the Australian Broadcasting Authority, pertains to the variation of the Licence Area Plan (LAP) for radio broadcasting in Hobart, Tasmania, under the Broadcasting Services Act 1992 (section 26). The variation, effective from March 2003, includes changes to the technical specifications of certain community radio services in the Hobart area. Specifically, the LAP now includes a new transmitter for a community radio service operating on 106.5 MHz, replacing an existing transmitter operating on 103.3 MHz. This change is intended to enhance the coverage and quality of community radio broadcasting in the Hobart region. The Act imposes obligations on the parties governed by the LAP, requiring them to adhere to the specified technical parameters for broadcasting services. This includes ensuring that the designated frequencies, transmitter sites, and technical specifications are adhered to for the operation of community radio services. The LAP also specifies the general area that each transmitter is intended to serve, which in this case is the Hobart metropolitan area. Failure to comply with the provisions of the Broadcasting Services Act 1992, including the LAP, may result in penalties. The Act provides for both civil and criminal penalties for breaches. Civil penalties can include fines up to a specified amount determined by the courts, while criminal penalties can result in fines of up to a higher specified amount or imprisonment, or both. The exact penalties are not detailed in this legislative instrument but are prescribed in the Act itself. It is the responsibility of the Australian Broadcasting Authority to enforce compliance with the LAP and to take appropriate action against any breaches.
