Overview

The Licence Area Plan – Gosford Radio was introduced in 2000 under the Broadcasting Services Act 1992. This legislation was enacted to address the need for a structured approach to the allocation and management of radio frequencies in Australia. The Australian Broadcasting Authority, now known as the Australian Communications and Media Authority, prepared this plan to specify the radio broadcasting services to be available in the Gosford area of New South Wales, detailing the technical specifications and operational parameters for these services. This plan ensures the availability of two national, three commercial, four community, and two open narrowcasting services within the specified licence area, utilising designated broadcasting service bands.

Scope and Application

The Licence Area Plan – Gosford Radio, made under subsection 26(1) of the Broadcasting Services Act 1992, applies specifically to the radio broadcasting services in the Gosford area of New South Wales. The plan sets out the availability of two national radio broadcasting services, three commercial radio broadcasting services, four community broadcasting services, and two open narrowcasting services within the Gosford licence area. This area is defined by the Australian Bureau of Statistics, covering Gosford (City) and Wyong (Local Government Area). The technical specifications, including transmitter sites, frequencies, and emission details, for these services are detailed in the schedule and various attachments to the plan. The plan also outlines the geographic reach of the services, including specific coverage areas and special conditions such as interference limitations. Although the plan itself does not include provisions for exclusions, exemptions, or thresholds, these aspects could be further regulated through subordinate instruments or guidelines issued under the Broadcasting Services Act 1992. The plan was initially determined by the Australian Broadcasting Authority on 31 August 2000, and has since been subject to variations and amendments, the most recent of which was on 29 September 2017.

Key Provisions

The Licence Area Plan – Gosford Radio, made under subsection 26(1) of the Broadcasting Services Act 1992, outlines the availability of various radio broadcasting services in the Gosford area of New South Wales. This plan specifies that two national radio broadcasting services, three commercial radio broadcasting services, four community broadcasting services, and two open narrowcasting services are to be available in the specified area. The technical specifications, including frequency bands, transmitter locations, and output radiation patterns, for these services are detailed in the Schedule and Attachments 1.2 to 1.12 of the plan. The obligations imposed on parties governed by this Act include adhering to the specified technical parameters for transmitter locations and radiation patterns to ensure that the designated services are available within the Gosford licence area. Service providers must comply with the transmitter specifications provided in Attachments 1.2 to 1.12, which detail the exact locations, frequencies, and power outputs for each service. Additionally, any changes to these specifications must be reported and approved by the relevant authorities. Failure to comply with the provisions of this Licence Area Plan may result in legal consequences. The Act does not explicitly state penalties for non-compliance, but breaches of broadcasting regulations typically fall under the purview of the Broadcasting Services Act 1992 and the Broadcasting Act 1942. Penalties for these breaches can include fines and, in severe cases, revocation of broadcasting licences. The exact penalties depend on the specific breach and are determined by the relevant regulatory authorities.
