Overview

The Broadcasting Services Act 1992 was enacted to regulate and provide for the efficient use of the radio spectrum in Australia, ensuring that broadcasting services operate in a manner that promotes diversity and cultural expression. This Act was introduced to address the need for a comprehensive legal framework governing broadcasting services, including the allocation of radio frequencies, licensing, and the establishment of broadcasting standards. The Australian Broadcasting Authority, acting under the authority of this Act, varied the licence area plan for radio services in the Emerald area of Queensland to update the technical specifications of the open narrowcasting radio service, thereby addressing the need for efficient and effective radio frequency management. The policy objective of this variation was to ensure that the broadcasting services in the Emerald area are managed in a way that facilitates the provision of quality services to the community while maintaining the integrity and efficiency of the radio spectrum.

Scope and Application

The legislative instrument, F2005B00752, pertains to a variation to the licence area plan for radio services in the Emerald area of Queensland, which was initially determined on 5 March 1998. This variation specifically modifies the technical specifications for the open narrowcasting radio service in Moranbah, Queensland, under the authority of the Broadcasting Services Act 1992. The Australian Broadcasting Authority made this variation to update the technical specifications, which are detailed in the attached document and reflect the new requirements for the radio services in the area. The licence area plan itself details the category of services, their status, the frequencies, and the technical specifications for each transmitter. This variation applies to the Emerald area in Queensland and directly affects the open narrowcasting radio service in Moranbah. The instrument does not specify any exclusions or exemptions, and it is confined to the geographic area of Emerald, Queensland. Any further application or restriction of this legislation would be addressed through subordinate instruments, which may provide additional details or conditions for the radio services in this area.

Key Provisions

The key provisions of the legislative instrument primarily involve the variation of the technical specifications for the open narrowcasting radio service in the Emerald area of Queensland. The Australian Broadcasting Authority has modified the technical specifications for the open narrowcasting radio service identified by the technical specification number TS10007947, which serves the general area of Moranbah. The variation entails changes to the technical specifications as outlined in Schedule One and Attachment 1.31.1, replacing the previous specifications. This legislative instrument imposes specific obligations on entities involved in the provision of radio services in the Emerald area. Service providers must adhere to the updated technical specifications for the open narrowcasting radio service in Moranbah, as detailed in the revised Schedule One and Attachment 1.31.1. These specifications include transmitter site locations, frequency bands, output power, and other technical parameters necessary for the effective operation of the service. Breaches of the requirements set forth in this legislative instrument can result in both civil and criminal consequences. While the specific penalties are not detailed in the text provided, under the Broadcasting Services Act 1992, penalties for non-compliance can include fines and, in severe cases, criminal charges. The exact penalties would depend on the nature and severity of the breach, as well as any relevant provisions of the Act. It is important for entities governed by this Act to ensure strict compliance with the specified technical standards to avoid these potential consequences.
