Overview

The Broadcasting Services Act 1992 was enacted to regulate the provision of broadcasting services in Australia. This legislation aims to ensure that broadcasting services are provided in a manner that is efficient, effective, and responsive to the needs of the community. The Act provides for the regulation of broadcasting services by the Australian Communications and Media Authority (ACMA), including the issuance of broadcasting licences and the imposition of conditions on those licences. The Licence Area Plan – Charleville Radio is a legislative instrument made under the Broadcasting Services Act 1992 by the ACMA. The plan specifies the broadcasting services that are to be available in the Charleville area of Queensland, including national, commercial, and community radio services, and open narrowcasting radio services. The plan also sets out the technical specifications for the provision of these services, including the frequency bands and transmission power levels that are to be used. The Licence Area Plan – Charleville Radio was made under subsection 26(1) of the Broadcasting Services Act 1992 and was registered on 14 April 2005. The plan has since been varied on several occasions, most recently on 5 December 2022. The policy objective of the Licence Area Plan – Charleville Radio is to ensure that the residents of the Charleville area have access to a range of broadcasting services that meet their needs and interests. The plan also aims to promote competition and diversity in the broadcasting sector, while ensuring that broadcasting services are provided in a manner that is consistent with the public interest.

Scope and Application

The Licence Area Plan – Charleville Radio is made under subsection 26(1) of the Broadcasting Services Act 1992 and specifies the availability of various radio broadcasting services in the Charleville area of Queensland. This plan determines the types of radio services, including national, commercial, open narrowcasting, and community radio services, to be made available in the specified licence areas. It also outlines the technical specifications for the transmitters, including channel frequencies, maximum antenna heights, and output radiation patterns. The plan applies to entities providing radio services in the specified licence areas, and it is subject to variations and amendments as outlined in the legislation. The scope of this plan is limited to the broadcasting services within the Charleville area and does not extend to other geographic regions or types of broadcasting services not specified in the plan.

Key Provisions

The Licence Area Plan – Charleville Radio specifies the broadcasting services available in the Charleville area of Queensland, including the technical specifications for each service (section 1). The plan outlines two national radio broadcasting services, two commercial radio broadcasting services, three open narrowcasting radio broadcasting services, and one community radio broadcasting service to be available in the area. The technical specifications, such as channel/frequency, transmitter details, and area served, are detailed in Schedule One and Attachments 1.1 to 1.22 for national, commercial, and open narrowcasting services, and in Schedule Two and Attachments 2.2 to 2.4 for community services. Licensing authorities and broadcasters are required to adhere to the outlined technical specifications and service categories to ensure compliance with broadcasting standards. Broadcasters must operate within the specified parameters, such as frequency, transmitter location, and emission characteristics, to maintain service quality and avoid interference. Licensing authorities are responsible for overseeing the implementation and enforcement of these specifications to ensure broadcasters comply with the Licence Area Plan. Breaches of the Licence Area Plan – Charleville Radio may result in enforcement actions by the Australian Communications and Media Authority (ACMA). Potential consequences include fines, suspension or revocation of broadcasting licenses, and other administrative penalties. The severity of the penalty depends on the nature and extent of the breach. For example, operating outside the specified technical parameters or failing to adhere to service categories can lead to significant penalties. It is essential for broadcasters and licensing authorities to comply with the plan to avoid such consequences.
