Overview

The Broadcasting Services Act 1992 was enacted to regulate the provision of broadcasting services in Australia, ensuring they comply with national standards and cater to public interest. This Act was introduced to address the need for a comprehensive regulatory framework governing broadcasting services, including radio and television, to manage spectrum use and content standards effectively. The Australian Broadcasting Authority, under subsection 26(1) of the Act, has the power to determine licence areas for broadcasting services. This determination for the Bridgetown area of Western Australia aims to provide specific national, commercial, and community radio services to the defined regions, ensuring a diverse range of broadcasting services to meet the community's needs. The policy objective is to provide accessible and varied broadcasting services that cater to the public interest while adhering to technical and operational standards.

Scope and Application

The Licence Area Plan Bridgetown (Radio) October 1996 applies to the provision of broadcasting services in the Bridgetown area of Western Australia. This determination by the Australian Broadcasting Authority outlines the availability of various radio broadcasting services, including five national radio broadcasting, two commercial radio, and one open narrowcasting radio broadcasting services. The technical specifications and transmitter details for these services are provided in the Schedules and Attachments. The Plan also specifies the availability of one community radio broadcasting service in the Bridgetown area, along with its technical specifications. This legislation applies specifically to the Bridgetown area in Western Australia and does not extend to other regions. The technical details for the transmitters, including their locations, frequencies, and radiation patterns, are documented in the various attachments to this determination. The Broadcasting Services Act 1992 mandates service licences only for commercial and community services, hence the national services do not have a service licence number. The determination also includes specific exclusions and technical details pertaining to the services and transmitters involved.

Key Provisions

This legislative instrument, Licence Area Plan Bridgetown (Radio) October 1996 Licence Area Plan - Bridgetown Determination, sets out the broadcasting services to be available in the Bridgetown area of Western Australia, as determined by the Australian Broadcasting Authority under subsection 26(1) of the Broadcasting Services Act 1992. Specifically, the document details the types of services available, including five national radio broadcasting services, two commercial radio broadcasting services, one open narrowcasting radio broadcasting service, and one community radio broadcasting service. The technical specifications and areas served by each transmitter are outlined in the Schedules and Attachments of the document. The Act imposes several obligations on the parties and entities it governs. Broadcasters must ensure that their services comply with the technical specifications set out in the document, such as the frequency bands, carrier frequencies, and radiation patterns. The document also specifies the licence area for each service, which is defined by the Australian Bureau of Statistics at the Census of 6 September 1991. Broadcasters must ensure that their services are available within the specified licence area. There are no specific offences or penalties mentioned in the document. However, non-compliance with the technical specifications or failure to provide services within the specified licence area may result in enforcement action by the Australian Communications and Media Authority or other relevant regulatory bodies. The Broadcasting Services Act 1992 provides for various offences and penalties for non-compliance with broadcasting regulations, including fines and imprisonment. The maximum penalties for offences under the Act depend on the specific offence and the circumstances of the case. In summary, this legislative instrument sets out the broadcasting services to be available in the Bridgetown area of Western Australia, including technical specifications and licence areas. Broadcasters must comply with these requirements and ensure that their services are available within the specified licence area. Non-compliance may result in enforcement action and potential penalties under the Broadcasting Services Act 1992.
