Overview

The Broadcasting Services Act 1992 was enacted to regulate and provide for the efficient use of radio frequencies in Australia. This legislation was introduced to address the need for a comprehensive legal framework governing the broadcasting industry, ensuring that broadcasting services are available to the public while managing the radio spectrum effectively. The Act was enacted by the Australian Parliament, with a policy objective to facilitate the provision of diverse and high-quality broadcasting services across the nation. Under the Act, the Australian Broadcasting Authority was responsible for creating licence area plans, such as the Licence Area Plan for Ballarat (Radio) in August 1997. This plan specified the availability and technical characteristics of various broadcasting services, including national, commercial, community, and open narrowcasting radio services, within the Ballarat area. The plan outlined the transmitter specifications, technical details, and the general areas served by each transmitter, aiming to ensure efficient broadcasting coverage and service availability in the region.

Scope and Application

The Licence Area Plan for Ballarat (Radio) Final - August 1997, made by the Australian Broadcasting Authority under the Broadcasting Services Act 1992, outlines the availability of various radio broadcasting services within the Ballarat area of Victoria. This determination specifies the technical characteristics and locations for three national radio broadcasting services, three commercial radio broadcasting services, one open narrowcasting radio broadcasting service, and two community radio broadcasting services. The services are allocated specific technical specifications, transmitter sites, and general areas served, as detailed in the schedules and attachments. Notably, the plan does not apply to any particular persons or entities but rather to the defined broadcasting services and their operational parameters within the Ballarat area. The determination does not include any stated exclusions or exemptions and is specific to the services listed within the Ballarat area, without extending to other regions or services outside of this scope. The technical specifications and operational details provided are integral to ensuring the effective and compliant operation of these broadcasting services in accordance with the Broadcasting Services Act 1992.

Key Provisions

This Licence Area Plan for Ballarat, established under subsection 26(1) of the Broadcasting Services Act 1992, specifies the types and technical specifications of radio broadcasting services to be made available in the Ballarat area of Victoria. According to the plan, three national radio broadcasting services, three commercial radio broadcasting services, one open narrowcasting radio broadcasting service, and two community radio broadcasting services are to be provided in the specified areas (Attachments 1.1 and 2.1). The technical specifications, including transmitter sites, frequencies, and maximum antenna heights, are detailed in Schedules One and Two and their respective attachments. Entities operating within the Ballarat area must adhere to the technical specifications outlined in the Licence Area Plan to ensure the provision of the specified broadcasting services. These entities include broadcasters operating national, commercial, and community radio services, and open narrowcasting services. Each service must comply with the designated transmitter specifications, frequency bands, and other technical parameters to maintain the integrity and quality of the broadcast services. Breaches of the technical specifications or failure to comply with the Licence Area Plan may result in regulatory action under the Broadcasting Services Act 1992. While the Licence Area Plan itself does not explicitly state penalties for non-compliance, violations of the Act can lead to enforcement actions, fines, or other penalties as prescribed by the Act. The Australian Communications and Media Authority (ACMA), successor to the Australian Broadcasting Authority, has the authority to investigate and take action against entities that fail to comply with broadcasting regulations.
