Laying Chicken Levy Regulations (Amendment)

The Laying Chicken Levy Act 1988 (the Act) imposes a levy on eligible laying chickens hatched in Australia, an amount in respect of which is directed to the Australian Animal Health Council Limited under the Australian Animal Health Council (Live-stock Industries) Funding Act 1996 for the coordination of animal health services for the industry.

Section 9(1) of the Act provides that the Governor-General may make Regulations to prescribe levy rates.

The levy for AAHC purposes reduced from 0.33 cent per laying chicken to 0.27 cent as from 1 July 1998. This regulation was made in response to a recommendation by the Australian Egg Industry Association (AEIA) to the Minister for Primary Industries and Energy. The industry recommendation reflects the reduction in the egg industry's indebtedness to the AAHC arising from outstanding subscriptions prior to enactment of the Australian Animal Health Council (Live-stock Industries) Funding Act 1996.

Details of the Regulations are set out below:

Regulation 1 the regulations commenced immediately after Statutory Rules 1997 No. 164 removed the 0.33 cent rate of levy, and before the minimum rate of 0.21 cent prescribed by the Act took effect.

Regulation cites the purposes of the regulations as amending the Laying .Chicken Levy Regulations.

Regulation 3 prescribed the levy per eligible laying chicken in respect of the AAHC at 0.27 cent as from 1 July 1998.

The regulations commenced on 1 July 1998.
