This property is located adjacent to the River Murray, approximately 6.5 kilometres downstream from Hume Dam, and approximately 4.7 kilometres south east of Albury, as set out in Schedule 1.

This declaration relates to the acquisition of an easement for flooding identified as "E-1" in Schedules 1-3, in the land specified in paragraph 2.

The public purpose of the acquisition is to enable the Murray-Darling Basin Authority to give directions for, and to manage, the release of water from the Hume Dam into the River Murray to meet the water requirements of NSW, Victoria and South Australia.

5.      Suitability for development for use for a public purpose

The land is located on an anabranch of the River Murray and forms part of the natural flow path and floodplain of the river system. As a result, it is suitable for the public purpose described in paragraph 4.

The proposed releases will be from Hume Dam into the River Murray at a rate of up to, but not exceeding, 25,000 megalitres in any period of 24 hours measured at the Doctors Point.

7.      Reasons why the land appears to be suitable for the proposed development for use

The land specified in paragraph 2 is suitable for the use described in paragraph 6 because it is a part of or is adjacent to an anabranch of the River Murray that is inundated when water is released from Hume Dam at flow rates of up to 25,000 megalitres in any period of 24 hours measured at the Doctors Point.

Overview

The Lands Acquisition Act 1989 was enacted to facilitate the acquisition of land or interests in land for public purposes by the Murray-Darling Basin Authority and other specified authorities. This legislation addresses the need to efficiently and effectively acquire lands that are essential for critical infrastructure and environmental management projects, particularly those that involve water resource management. The Murray-Darling Basin Authority, as the acquiring authority in this instance, aims to manage the release of water from Hume Dam into the River Murray to meet the water requirements of New South Wales, Victoria, and South Australia. This pre-acquisition declaration under the Act outlines the consideration of acquiring an easement for flooding on land adjacent to the River Murray, demonstrating the suitability of the land for the proposed development and the public purpose of managing water flow rates from Hume Dam.

Scope and Application

The Lands Acquisition Act 1989 applies to the Murray-Darling Basin Authority, a Commonwealth authority, which is the acquiring authority for the specified interests in land in this case. The legislation outlines the acquisition process for land deemed necessary for public purposes, particularly relating to water management in this instance. The geographic reach of this Act is national, with the Murray-Darling Basin Authority operating across multiple states within the basin, in this case, targeting an easement for flooding in the County of Bogong, Victoria. The acquisition is limited to the specified land, "Carlingford", and the particular easement identified as "E-1" in the provided schedules. The declared purpose for the acquisition is strictly for enabling the Authority to manage water releases from Hume Dam into the River Murray to meet water requirements across New South Wales, Victoria, and South Australia. The Act does not explicitly detail exclusions or exemptions in this declaration, but the suitability of the land for the public purpose and the specific nature of the acquisition are clearly outlined, indicating a targeted application without broad exemptions.

Key Provisions

The Lands Acquisition Act 1989, specifically the Pre-Acquisition Declaration outlined in the Gazette, sets forth the framework for the Murray-Darling Basin Authority to consider the acquisition of certain land interests. This declaration, dated September 13, 2016, identifies the specific land in question, the interests to be acquired, the intended public purpose of the acquisition, and the suitability of the land for this purpose. The land in question is the property known as "Carlingford," located in Lot 1 of Title Plan LP202754L in the County of Bogong, Parish of Bonegilla, Victoria. This property is adjacent to the River Murray, approximately 6.5 kilometres downstream from Hume Dam and 4.7 kilometres southeast of Albury. The declaration specifies that the acquisition pertains to an easement for flooding, designated as "E-1," and its purpose is to enable the Murray-Darling Basin Authority to manage the release of water from Hume Dam into the River Murray to meet the water requirements of New South Wales, Victoria, and South Australia. The Act imposes certain obligations on the Murray-Darling Basin Authority, including the requirement to provide a detailed Pre-Acquisition Declaration that outlines the specific land to be acquired, the nature of the interests, the public purpose of the acquisition, and the reasons for considering the land suitable for this purpose. The declaration must also specify the proposed development and the expected flow rates of water to be released from Hume Dam. Furthermore, the Act mandates that the land must be deemed suitable for the specified public purpose, which, in this case, is based on the land's location adjacent to an anabranch of the River Murray that is affected by water releases from Hume Dam at specified flow rates. This ensures that the land is appropriately situated to support the intended management of water releases. The Act also delineates the potential consequences for non-compliance or breaches of its provisions. While the specific offences, penalties, or consequences are not detailed in the Pre-Acquisition Declaration, the Lands Acquisition Act 1989 generally provides for both civil and criminal sanctions for breaches. Civil penalties may include fines and other monetary penalties, while criminal penalties could include imprisonment, depending on the nature and severity of the breach. The Act may also provide for remedies in cases of improper acquisition or failure to comply with its requirements, ensuring that the public interest and the legal process are upheld throughout the acquisition process.
