Overview
The Electoral Act 1918, as amended by the C2020G00440 (Gazette) in 2020, serves to facilitate the election of members to the House of Representatives in the event of a vacancy. This piece of legislation was introduced by the Parliament of Australia to address the vacancy created by the resignation of the Hon Dr Mike Kelly AM from the electoral division of Eden-Monaro. The primary objective of this Act is to ensure a seamless and timely electoral process that maintains the integrity of the democratic system in the Commonwealth of Australia. This includes setting specific dates for the close of rolls, close of nominations, and the date of polling, culminating in the return of the writ within a specified period.
Scope and Application
The notice issued under the authority of the Constitution of the Commonwealth of Australia pertains specifically to the electoral procedures for a by-election in the division of Eden-Monaro following the resignation of the Hon Dr Mike Kelly AM. This Act applies to the electoral processes and the individuals involved in the election of a new Member to serve in the House of Representatives. It outlines the key dates and deadlines for the electoral cycle, including the close of rolls on Thursday, 4 June 2020, the close of nominations on Tuesday, 9 June 2020, the date of polling on Saturday, 4 July 2020, and the return of writs on or before Saturday, 5 September 2020. The geographic reach of this Act is limited to the electoral division of Eden-Monaro within the Commonwealth of Australia. It does not specify any exclusions, exemptions, or thresholds, as it is focused on the administrative and procedural aspects of the by-election process.
Key Provisions
The primary sections of this legislation pertain to the notification of a writ for a by-election in the electoral division of Eden-Monaro, following the resignation of the Member of Parliament, Dr Mike Kelly AM (section 1). The legislation sets out key dates for the electoral process, including the close of rolls on Thursday, 4 June 2020 (section 2), the close of nominations on Tuesday, 9 June 2020 (section 3), and the date of polling on Saturday, 4 July 2020 (section 4). The final step, the return of the writ, must occur on or before Saturday, 5 September 2020 (section 5).
The Act imposes several obligations on the parties involved in the by-election process. Firstly, the Speaker of the House of Representatives, in this case, The Hon Tony Smith MP, is required to issue the writ for the by-election (section 1). The Electoral Commission, or relevant electoral body, must manage the close of rolls and ensure all eligible voters are registered (section 2). Candidates must submit their nominations by the specified close of nominations date (section 3). The Electoral Commission is also responsible for overseeing the polling process on the designated date of polling (section 4). Finally, the writ must be returned to the relevant authorities by the specified return of writ date (section 5).
The legislation does not explicitly outline offences, penalties, or consequences for breach within its text. However, the failure to adhere to the specified dates and processes could lead to legal challenges and potential invalidation of the election results. It is likely that any breaches of the electoral process would be subject to scrutiny by the courts or relevant electoral bodies, potentially resulting in the nullification of the by-election or other legal ramifications. The precise penalties or consequences would depend on the specific nature of the breach and would be determined by the applicable electoral laws and regulations.
