INVITATION TO COMMENT

DRAFT MANAGEMENT PLAN FOR THE SOUTH-WEST COMMONWEALTH MARINE RESERVES NETWORK

 

 

The Director of National Parks has prepared a draft management plan under the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) for the Commonwealth reserves in the South-west Commonwealth Marine Reserves Network. The draft management plan sets out how the South-west Commonwealth Marine Reserves Network will be managed for a period of ten years.

 

The South-west Commonwealth Marine Reserves Network came into effect on 17 November 2012. The reserves of the Network are:

 

Southern Kangaroo Island Commonwealth Marine Reserve

Western Kangaroo Island Commonwealth Marine Reserve

Western Eyre Commonwealth Marine Reserve

Murat Commonwealth Marine Reserve

Great Australian Bight Commonwealth Marine Reserve

Twilight Commonwealth Marine Reserve

Eastern Recherche Commonwealth Marine Reserve

South-west Corner Commonwealth Marine Reserve

Bremer Commonwealth Marine Reserve

Geographe Commonwealth Marine Reserve

Perth Canyon Commonwealth Marine Reserve

Two Rocks Commonwealth Marine Reserve

Jurien Commonwealth Marine Reserve

Abrolhos Commonwealth Marine Reserve

 

Members of the public are invited to comment on the draft management plan.  Comments may be made in relation to the management plan generally, or as it relates to individual reserves or particular activities within the network.

 

All comments received will be considered and the draft management plan may be revised accordingly. To ensure your comments are clear and concise please:

  • list your points in order, numbered according to the relevant sections or prescriptions (strategies and actions) of the draft plan
  • state whether you agree or disagree with prescriptions and give your reasons
  • if you disagree, suggest alternatives
  • include any matters relevant to management of the reserves in the South-west Commonwealth Marine Reserves Network that are not covered by the draft plan.

Comments on the draft management plan for the South-west Commonwealth Marine Reserves Network must be sent by Thursday 14th February 2013. Comments that are sent after that date or to addresses other than those above cannot be taken into account in finalising the South-west Commonwealth Marine Reserves Network management plan.

Overview

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) was enacted to provide for the protection of the environment, particularly the nation's biodiversity, and to ensure that the impacts of proposed actions are assessed in a timely and efficient manner. The Act addresses the gap in comprehensive environmental protection legislation by establishing a framework that integrates environmental considerations into decision-making processes at both federal and state levels. The EPBC Act aims to promote the sustainable use of natural resources while protecting the environment from significant harm. This legislation was enacted by the Parliament of Australia to provide a cohesive approach to environmental conservation and biodiversity protection, ensuring that all significant actions are evaluated for their potential environmental impacts. The policy objective of the Act is to balance economic development with the need to protect the environment, particularly focusing on threatened species, ecological communities, and heritage places of national significance.

Scope and Application

The Environment Protection and Biodiversity Conservation Act 1999 applies to the management of the South-west Commonwealth Marine Reserves Network, which encompasses various marine reserves along the South-west coast of Australia. This Act is applicable to the entities responsible for the management of these reserves, including the Director of National Parks, and extends to the industries and activities occurring within the designated marine reserve areas. The draft management plan prepared under this Act outlines the management strategies for the network over a ten-year period. The geographic reach of this Act is national, as it pertains to Commonwealth marine reserves. The Act does not specify any exclusions or exemptions but allows for the possibility of revising the draft management plan based on public comments. The management plan may also be extended or restricted through subordinate instruments, as deemed necessary by the Director of National Parks. Members of the public are invited to provide feedback on the draft plan, which must be submitted by 14 February 2013, to ensure their views are considered in finalising the management strategy for the marine reserves network.

Key Provisions

The draft management plan (Section 368(5)) outlines the proposed management strategies for the South-west Commonwealth Marine Reserves Network for the next ten years. Additionally, if the management plan does not adequately protect the environmental values of the reserves, it may not meet the objectives of the EPBC Act, potentially leading to enforcement actions by the Commonwealth Government. There are no specific penalties outlined for breaches of the management plan itself, but any unlawful activities within the reserves could result in fines or other sanctions under the EPBC Act or other relevant legislation.
