Overview

The Commonwealth Department of Finance has issued a draft Heritage Management Plan for Snapper Island, a location situated about 300 metres north-east of the Drummoyne Sailing Club in Sydney Harbour, NSW. Enacted under section 341S of the Environment Protection and Biodiversity Conservation Act 1999, this invitation for public comment aims to address the need for a comprehensive management plan that preserves the cultural and environmental heritage of the island. The policy objective is to ensure that the plan incorporates the interests and rights of First Nations people, relevant government agencies, and the public, fostering a collaborative approach to heritage conservation. The consultation period for this draft plan is open from Friday 23 February 2024 until 5.00pm AEDT on Friday 22 March 2024. Members of the public, organisations, First Nations people with rights and interests in the place, and relevant government agencies are invited to review the draft plan, either online or at the State Library of New South Wales, and submit their comments via email. This initiative by the Commonwealth Department of Finance aims to facilitate an inclusive process, ensuring that the final Heritage Management Plan is well-informed and reflective of diverse stakeholder perspectives.

Scope and Application

The draft Heritage Management Plan for Snapper Island, prepared by the Commonwealth Department of Finance, applies to the general public, organisations, groups with an interest in the island, First Nations people with rights and interests in the place, and relevant government agencies. The plan pertains to the management and conservation of Snapper Island, which is located in Sydney Harbour, NSW, and falls within the jurisdiction of the Commonwealth under the Environment Protection and Biodiversity Conservation Act 1999. The invitation for public comment underscores the inclusive approach taken to ensure diverse perspectives and expertise are incorporated into the management strategy. The consultation period provides an opportunity for stakeholders to review the draft plan, either online or in person at the State Library of New South Wales, and submit their feedback through specified channels. This collaborative process is essential for the development of a comprehensive and effective Heritage Management Plan that addresses the island's ecological, cultural, and historical significance.

Key Provisions

The main operative sections of the document are section 341S of the Environment Protection and Biodiversity Conservation Act 1999, which mandates the preparation of a Heritage Management Plan for Snapper Island, and the invitation for public comment on the draft plan (section 1). This section requires the Commonwealth Department of Finance to develop a Heritage Management Plan for the island and to invite relevant stakeholders to provide feedback. The consultation period is specified as running from Friday 23 February 2024 to 5.00pm AEDT on Friday 22 March 2024 (section 2). During this period, interested parties can access the draft plan online, view a physical copy at the State Library of New South Wales, and submit comments or enquiries via email. The Act imposes several obligations on the Department of Finance and the relevant stakeholders. The Department is required to prepare a draft Heritage Management Plan and ensure it is available for public consultation (section 341S). Relevant stakeholders, including members of the public, organisations, First Nations people, and government agencies, are expected to review the draft plan and provide feedback within the specified timeframe (section 1). Additionally, the Department must consider the comments received and incorporate them into the final plan, if appropriate. There are no explicit offences, penalties, or consequences for breach mentioned in the document. The focus is on the procedural requirements for preparing and consulting on the Heritage Management Plan. However, failure to comply with the Act and its regulations could potentially lead to legal challenges or administrative actions if the plan is not properly developed or if public consultation is not adequately conducted. The maximum penalties for breaches of the Act can be found in other sections of the Environment Protection and Biodiversity Conservation Act 1999, but they are not detailed in this particular document. In summary, the key provisions of this document outline the requirement to develop a Heritage Management Plan for Snapper Island, the process for public consultation, and the obligations on both the Department of Finance and the stakeholders to engage in this process. While the document does not detail specific penalties for non-compliance, adherence to the Act is crucial to avoid potential legal repercussions.
