Overview
Statutory Rules 1935, No. 57, the Invalid and Old-age Pensions Regulations, was enacted under the Invalid and Old-Age Pensions Act 1908-1935. These regulations were introduced to provide amendments and clarifications to the existing pension regulations, ensuring they remained relevant and effective in administering pensions for the elderly and invalid citizens. The regulations were made by the Governor-General in accordance with the advice of the Federal Executive Council, aiming to streamline the pension application and administration processes. The policy objective of these regulations is to ensure the smooth and efficient provision of pensions, which is vital for the welfare of the targeted beneficiaries.
Scope and Application
These Regulations under the Invalid and Old-age Pensions Act 1908-1935, made by the Governor-General acting with the advice of the Federal Executive Council, amend existing provisions and repeal specific regulations and forms. The amendments and repeals primarily focus on updating and streamlining the administration of pensions for invalids and the elderly. The changes include omitting certain dated references, modifying specific forms to personalise the information required, and repealing outdated or redundant regulations and forms. These Regulations apply nationally within the Commonwealth of Australia and are intended to enhance the efficiency and accuracy of pension administration. No specific exclusions or exemptions are stated within these Regulations, but their applicability is inherently limited to those governed by the Invalid and Old-age Pensions Act 1908-1935.
Key Provisions
The Statutory Rules of 1935, No. 57, made under the Invalid and Old-age Pensions Act 1908-1935, bring several amendments and repeals to existing regulations and forms. These changes primarily focus on modifying existing forms and repealing certain regulations and forms deemed no longer necessary. For instance, Regulation 35 is amended by omitting the specific date restriction mentioned in sub-regulation (1) (Section 2). Additionally, Regulations 41 and 44 to 50 are repealed entirely (Section 3).
These changes impose specific obligations on the entities governed by the Invalid and Old-age Pensions Act. The amendment to Form 23 removes a requirement to furnish information about family members over 21 years of age, streamlining the data collection process for pensioners (Section 4). Form 30 is also updated to specify the pensioner's name directly in the form, improving clarity and personalisation (Section 5). Furthermore, the removal of the date restriction in Form 40 (Section 6) and the repeal of Forms 43 and 46 to 52 (Section 7) simplifies the administrative process and reduces the paperwork required from pensioners and administrators alike.
In terms of consequences for non-compliance with these regulations, the document does not explicitly detail offences, penalties, or consequences for breaches. However, given the nature of statutory regulations, non-compliance could potentially result in administrative penalties, fines, or other legal repercussions under the broader Invalid and Old-age Pensions Act 1908-1935. The exact penalties would depend on the specific nature and severity of the breach, as outlined in the overarching legislation.
