Overview

The Invalid and Old-age Pensions Act 1908-1933, as amended through various legislative instruments including Statutory Rules 1935, No. 21, was enacted to address the need for a comprehensive pension system catering to the elderly and the disabled. These regulations, made under the authority of the Invalid and Old-age Pensions Act, aimed to streamline the administration and payment processes of pensions by updating and refining the procedural forms. The objective was to ensure that the pension payments were efficiently managed and that the pensioners' rights were protected. The Invalid and Old-age Pensions Regulations 1935 sought to amend specific forms, such as Form 33 and Form 38, to enhance the clarity and effectiveness of pension applications and payment authorisations. The enactment by the Governor-General in Council reflects the commitment to providing a stable and reliable pension system for the vulnerable segments of the population.

Scope and Application

The Invalid and Old-age Pensions Regulations 1935, made under the Invalid and Old-age Pensions Act 1908-1933, govern the administration of pensions within the Commonwealth of Australia. These regulations apply to pensioners and their representatives, as well as to officials within the pensions system, including Registrars of Pensions and Deputy Commissioners. The scope of these regulations extends to the issuance of warrants authorising payment of pensions to individuals other than the pensioner themselves, as outlined in Form 33. The regulations also cover the amendment of Form 38, which pertains to the recording of advices relating to pension payments, specifically noting when payments should be stopped. The geographic reach of these regulations is national, applying uniformly across all states and territories within Australia. The regulations do not specify exclusions, exemptions, or thresholds; however, they do extend their application through subordinate instruments such as the forms referenced within the regulations.

Key Provisions

The main operative sections of these Regulations (C1935L00021) amend the Invalid and Old-age Pensions Regulations by repealing Form 33 and inserting a new version, which is an application for a warrant authorising payment to a person other than the pensioner (reg 1). Form 38 is also amended to reflect changes in the recording of advices relating to payments, now referred to as the ‘Stop List’ (reg 2). These Regulations impose certain obligations on applicants for a warrant. They must provide a detailed application in Form 33, including the full name and address of the proposed payee and a clear statement of the reasons for the application (reg 1(b)). The applicant must also confirm they are not planning to leave Australia or become an inmate of a specified institution. Furthermore, the applicant must consent to the issuance of the warrant, and if unable to sign, must have the form witnessed (reg 1). The Registrar of Pensions is required to recommend whether the application should be refused or granted, which is to be recorded on the form (reg 1). Violation of the requirements set out in these Regulations could lead to civil or administrative consequences. For example, submitting a false or misleading application could be considered a breach of the conditions under which the pension is paid, potentially leading to the cessation of pension payments or other penalties as deemed appropriate by the relevant authorities. However, the specific penalties for such breaches are not detailed in the Regulations themselves but would be governed by the provisions of the Invalid and Old-age Pensions Act 1908-1933 and any other relevant legislation.
