1  Name of Regulations

These Regulations are the Interstate Road Transport Charge Regulations 2009.

3  Definitions

  In these Regulations:

Act means the Interstate Road Transport Charge Act 1985.

4  Registration charges—2017‑2018 financial year

 (1) For the purposes of subsection 5(3) of the Act, the amount of the charge for the registration of a vehicle for a full year of registration that begins during the 20172018 financial year is worked out using the formula:

where:

regulatory component means:

 (a) if the vehicle is a load carrying vehicle of a kind mentioned in the table in subregulation (5)—the amount set out in that table for that kind of load carrying vehicle; or

 (b) if the vehicle is a trailer of a kind mentioned in the table in subregulation (6)—the amount set out in that table for that kind of trailer; or

 (c) if the vehicle is a bus of a kind mentioned in the table in subregulation (7)—the amount set out in that table for that kind of bus.

road component means:

 (a) if the vehicle is a load carrying vehicle of a kind mentioned in the table in subregulation (2)—the amount set out in that table for that kind of load carrying vehicle; or

 (b) if the vehicle is a trailer of a kind mentioned in the table in subregulation (3)—the amount set out in that table for that kind of trailer; or

 (c) if the vehicle is a bus of a kind mentioned in the table in subregulation (4)—the amount set out in that table for that kind of bus.

Example: The road component set out in subregulation (2) for a truck (type 1) with 2 axles is $412 and the regulatory component set out in subregulation (5) for that kind of truck is $199. The amount of the charge for the registration of a truck (type 1) with 2 axles is therefore $611.

where:

road component means:

 (a) if the vehicle is a load carrying vehicle of a kind mentioned in the table in subregulation (2)—the amount set out in that table for that kind of load carrying vehicle; or

 (b) if the vehicle is a trailer of a kind mentioned in the table in subregulation (3)—the amount set out in that table for that kind of trailer; or

 (c) if the vehicle is a bus of a kind mentioned in the table in subregulation (4)—the amount set out in that table for that kind of bus.

Example: The road component set out in subregulation (2) for a truck (type 1) is $418 and the regulatory component set out in subregulation (5) for a truck (type 1) is $202. The amount of the charge for the registration of a truck (type 1) is therefore $620.

The amendment history in endnote 4 provides information about amendments at the provision (generally section or equivalent) level. It also includes information about any provision of the compiled law that has been repealed in accordance with a provision of the law.

Editorial changes

The Legislation Act 2003 authorises First Parliamentary Counsel to make editorial and presentational changes to a compiled law in preparing a compilation of the law for registration. The changes must not change the effect of the law. Editorial changes take effect from the compilation registration date.

If the compilation includes editorial changes, the endnotes include a brief outline of the changes in general terms. Full details of any changes can be obtained from the Office of Parliamentary Counsel.

Misdescribed amendments

A misdescribed amendment is an amendment that does not accurately describe the amendment to be made. If, despite the misdescription, the amendment can be given effect as intended, the amendment is incorporated into the compiled law and the abbreviation “(md)” added to the details of the amendment included in the amendment history.

If a misdescribed amendment cannot be given effect as intended, the abbreviation “(md not incorp)” is added to the details of the amendment included in the amendment history.

Overview

The Interstate Road Transport Charge Regulations 2009 were enacted under the Interstate Road Transport Charge Act 1985 by the Parliament of Australia to address the need for a structured and transparent system for setting road transport charges across state borders. This legislation aims to ensure that the costs associated with the wear and tear of roads due to heavy vehicles are fairly distributed, while also providing a clear framework for the calculation and collection of these charges. The Interstate Road Transport Charge Regulations 2009 detail the specific registration charges for different types of vehicles, such as trucks, trailers, and buses, for the financial years 2016-2017 and 2017-2018, providing a formula and tables for determining the road and regulatory components of the charge.

Scope and Application

The Interstate Road Transport Charge Regulations 2009, made under the Interstate Road Transport Charge Act 1985, apply to the registration of vehicles used for interstate road transport in Australia, specifically determining the registration charges for various types of load carrying vehicles, trailers, and buses for the financial years 2017-2018 and 2016-2017. These charges are broken down into road components and regulatory components, each calculated based on the type and configuration of the vehicle. The Regulations are applicable across the Commonwealth of Australia, impacting entities and individuals involved in interstate road transport, including operators of commercial vehicles. Notably, the regulations were repealed at the start of 1 July 2018, with subsequent amendments and charges potentially governed by new legislative instruments or regulations.

Key Provisions

The Interstate Road Transport Charge Regulations 2009 (Regulations) provide detailed guidelines on the calculation of registration charges for vehicles involved in interstate road transport for the 2017-2018 financial year. These charges are calculated based on a formula that combines a 'regulatory component' and a 'road component'. The regulatory component is determined by the type of vehicle, as outlined in tables within the Regulations, which differentiate between load carrying vehicles, trailers, and buses. The road component is similarly calculated based on the vehicle's characteristics, with specific rates assigned to different types and configurations of vehicles. For example, the road component for a truck (type 1) with 2 axles is $412, while the regulatory component for the same vehicle is $199. Thus, the total registration charge for this vehicle would be $611. These Regulations impose specific obligations on entities required to register their vehicles for interstate road transport. They must ensure that their vehicles are classified correctly according to the tables provided, and that the appropriate registration charges are calculated and paid. This involves verifying the type and configuration of the vehicle, as well as the financial year during which the registration is being processed. Failure to comply with the Interstate Road Transport Charge Regulations 2009 can result in legal consequences. The Interstate Road Transport Charge Act 1985, under which these Regulations are made, provides for various penalties and enforcement measures. While the specific penalties are not detailed within the Regulations themselves, they generally include fines and potential legal actions against entities that fail to register their vehicles or pay the correct charges. The exact penalties can vary based on the severity of the breach and jurisdictional considerations. It is important for entities subject to these Regulations to ensure compliance to avoid these potential consequences.
