Overview

The Interpretation Ordinance 1973, enacted by the Cocos (Keeling) Islands Act 1955-1966, was introduced to update and modernise the interpretation and application of legal terms within the Territory's existing legislative framework. The enacting body was the Governor-General of Australia, acting on advice from the Executive Council. This legislative instrument aimed to address the need for legislative clarity and consistency, particularly in the context of the changing publication practices of the Commonwealth government, by aligning the Territory's legislative instruments with the new Australian Government Gazette. The policy objective was to ensure that legal references and definitions remain relevant and accurately reflect the current administrative practices of the Australian government.

Scope and Application

The Interpretation Ordinance 1973 amends the Interpretation Ordinance 1955-1966, and it applies specifically to the Territory of Cocos (Keeling) Islands. The amended ordinance updates the definition of "the Gazette" to include both the Commonwealth of Australia Gazette published before 1st July 1973 and the Australian Government Gazette published on or after that date, as well as the Government Gazette of the Territory. This amendment affects any legislation or conduct that references "the Gazette" within the Territory. The ordinance also modifies the references to certain expressions in other laws to reflect these changes. The scope of this ordinance is limited to the Territory of Cocos (Keeling) Islands, and it does not extend beyond this jurisdiction. The ordinance does not specify any exclusions, exemptions, or thresholds, nor does it indicate that its application is extended or restricted through subordinate instruments.

Key Provisions

The Interpretation Ordinance 1973 amends the Interpretation Ordinance 1955-1966, with significant changes primarily in the definitions and references to official gazettes (s. 1, 2, and 4). Firstly, the Ordinance modifies the definition of "the Gazette" to include both the Commonwealth of Australia Gazette published before 1st July 1973 and the Australian Government Gazette published on or after that date, as well as the Government Gazette of the Territory (s. 2). Secondly, it updates Section 10 to acknowledge the Australian Government Gazette as evidence alongside the Commonwealth of Australia Gazette. Finally, Section 18 is amended to reflect these changes, ensuring that references to the gazettes in other laws are consistent with the updated definitions. The obligations under this Ordinance primarily concern the accurate referencing and use of gazettes in legal contexts. Parties and entities governed by this legislation must ensure that they are using the correct and most current versions of the gazettes as defined in the Ordinance. This includes updating any references to the Commonwealth of Australia Gazette to account for the change in publication to the Australian Government Gazette from 1st July 1973 onwards. The Ordinance does not explicitly outline specific offences, penalties, or consequences for breaches of its provisions. However, any failure to comply with the updated definitions and references to gazettes could potentially lead to legal challenges regarding the validity of legal documents, notices, or other communications that rely on these gazettes. Such challenges could result in legal disputes, which might require resolution through the courts. The specific outcomes of such disputes would depend on the particular circumstances and the discretion of the court.
