International Organization for Migration (Privileges and Immunities) Regulations (Amendment)

Section 13 of the International Organizations (Privileges and Immunities) Act 1963 (the Act) provides that the Governor-General may make regulations, not inconsistent with the Act, prescribing all matters which are required, or which are necessary or convenient to be prescribed, for carrying out or giving effect to the Act.

The purpose of the Regulations is to rectify drafting errors in Regulations 3 and 6 of the International Organization for Migration (Privileges and Immunities) Regulations.

The amendment to Regulation 3 clarifies that the International Organization for Migration is an "international organisation" to which the Act applies. The new Regulation 6 makes clear that the privileges and immunities specified in paragraphs 1, 2, 3, 4, 5 and 6 of Part 1 of the Fourth Schedule to the Act apply to officers of the Organisation only and that the privileges and immunities specified in Part 11 of the Fourth Schedule to the Act apply to former officers of the Organisation only.

The International Organization for Migration is required to notify the Minister for Foreign Affairs of any changes in its officers or former officers who are granted privileges and immunities under the Regulations. Furthermore, the Organisation must ensure that its officers and former officers act in accordance with the provisions of the Act and the Regulations. Failure to comply with the Act or the Regulations may result in legal consequences. The Act provides for civil and criminal penalties for breaches. For example, an offence under section 17 of the Act, which prohibits interference with the Organisation or its officers, carries a maximum penalty of five years imprisonment or a fine of $30,000, or both. Additionally, officers and former officers who misuse the privileges and immunities granted to them may face legal action, including fines and imprisonment, depending on the severity of the breach. The precise penalties for breaches are outlined in the Act and may vary based on the specific provision contravened.
