Overview

The Interim Forces Benefits Act 1947 was enacted to address the need for consistent and comprehensive benefits for members of the armed forces and their dependants. The Act was introduced by the Parliament of Australia, aiming to provide a structured framework for the provision of benefits in an interim period until a more permanent solution could be implemented. This legislative instrument, Statutory Rules 1948 No. 108, under the Interim Forces Benefits Act 1947, was designed to amend existing regulations to better align with the objectives of the Act. The policy objective of these regulations was to ensure that certain provisions from the Australian Soldiers' Repatriation Regulations were appropriately adapted to the Interim Forces Benefits Regulations, thereby streamlining the benefits process for military personnel and their families. The regulations sought to modify existing rules to reflect the current needs and to enhance the efficiency of the benefits system.

Scope and Application

The Interim Forces Benefits Regulations 1948, made under the Interim Forces Benefits Act 1947, apply to members of the armed forces and their dependants, ensuring that certain provisions of the Australian Soldiers’ Repatriation Regulations are extended to them. This legislative instrument primarily governs the benefits and provisions applicable to these individuals, subject to specific modifications and adaptations outlined in the Schedule. The application of these regulations is limited to the Commonwealth of Australia, indicating a national jurisdictional reach. The regulations are designed to adapt and incorporate specific provisions from the Australian Soldiers’ Repatriation Regulations, which are subject to the stated modifications. The amendments to the Interim Forces Benefits Regulations further specify the extent to which these provisions apply, making explicit changes to certain regulatory references within the Schedule.

Key Provisions

The main operative sections of these Regulations, as outlined, involve the amendment of Regulation 31 of the Interim Forces Benefits Regulations, replacing it with a new regulation that extends specific provisions from the Australian Soldiers' Repatriation Regulations to members and their dependants of the armed forces. The specific provisions that are to be extended include regulation 5, Parts II and III, regulations 77, 103 and 103A, Divisions 1, 5 and 6 of Part IX, and regulations 176A, 176B, 176C, 176D, 185, 188, 189, 190, 191, 192, 192A and 192B of the Australian Soldiers' Repatriation Regulations (section 1). The Schedule to the Regulations is also amended to reflect these changes, specifically modifying Regulation 53 to substitute references from "these Regulations" to "the Interim Forces Benefits Regulations" and from "these Regulations" to "the Australian Soldiers' Repatriation Regulations" (section 2). These Regulations impose specific obligations on the parties governed by them. They require that certain provisions from the Australian Soldiers' Repatriation Regulations be applied to members and their dependants of the armed forces, subject to modifications as outlined in the Schedule. The Regulations necessitate adjustments in the referencing of the Interim Forces Benefits Regulations and the Australian Soldiers' Repatriation Regulations within Regulation 53, ensuring that the correct regulatory framework is applied to the relevant parties. The Regulations do not explicitly state any offences, penalties, or civil/criminal consequences for breaches. However, by extending specific provisions from the Australian Soldiers' Repatriation Regulations, the Regulations implicitly enforce the compliance with those provisions, which may include penalties as outlined in the Australian Soldiers' Repatriation Regulations. The precise nature and extent of any penalties would depend on the specific provisions being enforced and the circumstances of any non-compliance.
