EXPLANATORY STATEMENT
Issued by the Authority of the Greenhouse and Energy Minimum Standards Regulator
Greenhouse and Energy Minimum Standards Act 2012
Instrument under section 37 of the Greenhouse and Energy Minimum Standards Act 2012
Power and Purpose
- Section 70 of the Greenhouse and Energy Minimum Standards Act 2012 (Act) provides for the designation of the position of the GEMS Regulator.
- The functions of the GEMS Regulator are set out in section 71 of the Act, including the responsibility for monitoring and enforcing compliance with the Act.
- Section 37 of the Act sets out the power of the GEMS Regulator to exempt models of GEMS products from the requirements of GEMS determinations. GEMS determinations are defined in section 11 of the Act.
- Section 37 of the Act enables the GEMS Regulator, by legislative instrument, to exempt models of GEMS products from one or more requirements of a GEMS determination in relation to all or specified supplies or uses of products of that model and enables the GEMS Regulator to specify conditions to which the exemption is subject.
- Section 37 also provides that regulations may be made in order to provide a framework for administrative processes around the submission and assessment of applications for exemption.
Consultation
6. The exemption set out in the instrument was considered on application from the particular supplier named in the instrument. No further consultation was considered necessary.
Contents of the Instrument
7. Section 1 sets out that the instrument is made under section 37 of the Act.
8. Section 2 provides for the commencement of the instrument.
9. Section 3 exempts the models of air conditioners specified in the Schedule to the instrument from the energy use and testing requirements of section 6 of the Greenhouse and Energy Minimum Standards (Air Conditioners and Heat Pumps) Determination 2012 (Determination), subject to the conditions specified in section 4 of the instrument.
10. Section 4 specifies the condition to which the exemption is subject. The condition limits the supply of the exempted models of air conditioners, to the supply for use in the Australia Pacific Liquefied Natural Gas Project and the Gladstone Liquefied Natural Gas Project. The restriction on supply is due to the specified models being specifically engineered to meet the safety and reliability requirements of the operating environment at the specified facilities. The impact of those safety and reliability requirements on the energy efficiency of the specified models of air conditioners, on their ability to comply with the minimum energy performance standards set in the Determination, was a reason for the exemption being granted.
11. Section 5 sets out the definition of terms used in the instrument.
12. The Schedule to the instrument sets out the manufacturer and the models of exempted air conditioners.
Making the Instrument
13. The instrument has been made by the GEMS Regulator in accordance with section 37 of the GEMS Act.
Overview
The Greenhouse and Energy Minimum Standards Act 2012 was enacted to address the problem of inadequate energy efficiency standards for certain products, aiming to reduce greenhouse gas emissions and promote energy conservation. This Act established the Greenhouse and Energy Minimum Standards Regulator (GEMS Regulator) to oversee the enforcement and compliance of these standards. The Parliament of Australia passed this legislation with the policy objective of improving energy efficiency across various product categories, thereby contributing to environmental sustainability and energy conservation. The Act provides the GEMS Regulator with the authority to exempt specific models of products from certain energy efficiency requirements if they are deemed necessary for particular applications or environments, subject to certain conditions to ensure minimal environmental impact. This legislative instrument exemplifies the regulator's role in balancing efficiency standards with practical application needs.
Scope and Application
The Greenhouse and Energy Minimum Standards Act 2012 applies to various entities, including manufacturers, importers, and suppliers of products that fall under the scope of the Act. This legislation is applicable on a national level, with the GEMS Regulator overseeing compliance across the entire country. The Act mandates minimum standards for the energy efficiency of products, which is enforced through determinations made by the Regulator. Specifically, this instrument pertains to air conditioners and their energy use and testing requirements. It enables the exemption of certain models of air conditioners from the energy efficiency standards specified in the Greenhouse and Energy Minimum Standards (Air Conditioners and Heat Pumps) Determination 2012, provided these exemptions are subject to particular conditions. The exemption in this case is limited to the supply of specified models of air conditioners for use in the Australia Pacific Liquefied Natural Gas Project and the Gladstone Liquefied Natural Gas Project, due to their specific engineering requirements that impact their energy efficiency.
Key Provisions
The Greenhouse and Energy Minimum Standards Act 2012 (GEMS Act) is primarily concerned with establishing and enforcing minimum standards for energy efficiency and greenhouse gas emissions of certain products. The GEMS Regulator, designated under section 70 of the Act, is responsible for monitoring and enforcing compliance with the Act, including making determinations regarding minimum standards and administering exemptions where necessary. Section 37 of the Act allows the GEMS Regulator to exempt specific models of GEMS products from certain requirements of GEMS determinations through a legislative instrument, subject to specified conditions. This is done to ensure that products can meet unique operational requirements without compromising on safety and reliability, particularly in critical environments.
Under this legislative instrument, section 3 exempts certain models of air conditioners from the energy use and testing requirements outlined in the Greenhouse and Energy Minimum Standards (Air Conditioners and Heat Pumps) Determination 2012 (section 6 of the Determination). This exemption is limited to the supply of these models for use in the Australia Pacific Liquefied Natural Gas Project and the Gladstone Liquefied Natural Gas Project (section 4). The rationale behind this exemption is that the specified models of air conditioners have been specifically engineered to meet the stringent safety and reliability requirements of these operating environments. The conditions imposed on the exemption ensure that the exempted models are only used where their unique design characteristics are necessary, thereby balancing operational needs with regulatory standards.
The obligations imposed on the parties governed by this legislation include adherence to the conditions specified in the exemption. For the exempted models of air conditioners, this means that they can only be supplied for use in the specified projects. The supplier named in the instrument must ensure that these models are not used outside the scope of the projects for which the exemption is granted. Additionally, any changes in the use or supply of these models must comply with the conditions outlined in the legislative instrument. Failure to comply with these conditions could result in enforcement actions by the GEMS Regulator.
Breach of the conditions specified in the exemption can lead to serious consequences. While the Act does not explicitly outline penalties for non-compliance, breaches of GEMS regulations typically result in enforcement actions, which may include fines, corrective actions, or further regulatory scrutiny. The maximum penalties for breaches of GEMS regulations can be substantial, reflecting the importance of compliance with energy efficiency and greenhouse gas emission standards. In addition to financial penalties, non-compliance could also result in reputational damage and legal costs for the parties involved. It is therefore crucial for all parties to strictly adhere to the conditions and requirements set out in the exemption and the broader legislative framework.
