AIRPORTS (PROTECTION OF AIRSPACE) REGULATIONS 1996

Instrument of Declaration of Prescribed Airspace for Brisbane Airport 2025

I, Brendon Montgomery, Acting Director, Airport Regulatory Compliance, Airports Branch, Domestic Aviation and Reform Division, of the Commonwealth Department of Infrastructure, Transport, Regional Development, Communications and the Arts and delegate of the Secretary, under subregulation 5(1) of the Airports (Protection of Airspace) Regulations 1996:

DECLARE as prescribed airspace for Brisbane Airport the airspace above any part of:

• the Obstacle Limitation Surface, identified in Schedule 1 to this Instrument;
• the Procedures for Air Navigation Systems Operations Surface, identified in Schedule 2 to this Instrument;
• the Navigational Aid Surface, identified in Schedule 3 to this Instrument;
• the High Intensity Approach Lighting Surface, identified in Schedule 4 to this Instrument; and
• the Precision Approach Path Indicator Surface, identified in Schedule 5 to this Instrument.

Note:   The declaration of prescribed airspace for Brisbane Airport dated 14 July 2017 and notified in Commonwealth of Australia Gazette No. C2017G00851, 31 July 2017 (as amended by this instrument) declares Radar Sector Altitude (RLSALT) Surfaces as prescribed airspace for Brisbane Airport.

AMEND the declaration of prescribed airspace for Brisbane Airport dated 14 July 2017 and notified in Commonwealth of Australia Gazette No. C2017G00851, 31 July 2017 (the 2017 Declaration) by:

• Omitting from the 2017 Declaration:

‘1. The current Procedures for Air Navigation Systems Operations (PANS-OPS) Surfaces identified in Schedule 1 to this instrument;

2. The future Procedures for Air Navigation Systems Operations (PANS-OPS) Surfaces identified in Schedule 2 to this instrument;’.

• Omitting from the 2017 Declaration:

‘4. the Visual Segment Surfaces (VSS) identified in Schedules 4 A,B and C to this instrument;

5. the Navigational Aid Surfaces identified in Schedule 5 to this instrument;

6. the High Intensity Approach Lighting (HIAL) Surfaces identified in Schedule 6 to this instrument; and

7. the future Precision Approach Path Indicator (PAPI) Surfaces identified in Schedule 7 to this instrument.’.

• Repealing Schedules 1, 2, 4A, B and C, and 5 to 7 to the 2017 Declaration. 

Note:  Subsection 33(3) of the Acts Interpretation Act 1901—which applies to the Airports (Protection of Airspace) Regulations 1996 because of paragraph 13(1)(a) of the Legislation Act 2003—relevantly provides for the repeal and variation of instruments.

REVOKE the declaration of prescribed airspace for Brisbane Airport dated 19 April 2013 and notified in Commonwealth of Australia Gazette No.C2013G00732, 15 May 2013.
