1  Name

  This instrument is the Industry Research and Development (Northern Endeavour Temporary Operations Program) Instrument 2020.

3  Authority

  This instrument is made under section 33 of the Industry Research and Development Act 1986.

4  Definitions

  In this instrument:

Act means the Industry Research and Development Act 1986.

decommissioning includes all activities associated with or connected to the decommissioning of the Northern Endeavour, including the:

(a)  disconnection, removal and disposal of the Northern Endeavour; and

(b) suspension, permanent plugging and abandonment of wells in the Laminaria-Corallina fields and flushing of associated pipelines; and

(c) removal and disposal of subsea infrastructure from the Laminaria-Corallina fields.

Laminaria-Corallina fields means the areas covered by petroleum production licences AC/L5 and WA-18-L.

Northern Endeavour means the Northern Endeavour floating production storage and offtake facility (Australian General Shipping Register official number 860769).

program means the Northern Endeavour Temporary Operations Program.

5  Prescribed program

 (1) For the purposes of subsection 33(1) of the Act, the program is prescribed.

 (2) The program provides funding to support:

 (a) the operation and maintenance of:

 (i) the Northern Endeavour; and

 (ii) the wells and subsea infrastructure in the Laminaria-Corallina fields; and

 (b) decommissioning and activities in preparation for decommissioning; and

 (ba) remediation of the Laminaria-Corallina fields; and

 (c) responding to emergencies relating to the Northern Endeavour or the wells and subsea infrastructure in the Laminaria-Corallina fields, including activities to:

 (i) minimise harm to human life or the environment; and

 (ii) secure the safety and structural integrity of the Northern Endeavour and the wells and subsea infrastructure in the Laminaria-Corallina fields; and

  (d) obtaining insurance in relation to the matters at paragraphs (a), (b), (ba) and (c); and

 (e) membership of organisations that provide oil spill response services, training and equipment.

6  Specified legislative power

For the purposes of subsection 33(3) of the Act, the power of the Parliament to make laws with respect to external affairs (within the meaning of paragraph 51(xxix) of the Constitution) is specified.
