Overview

The Industry Research and Development (Australian Made Export Initiative Program) Instrument 2019 is a legislative instrument made under section 33 of the Industry Research and Development Act 1986 by the Parliament of Australia. This instrument was enacted to address the need for enhancing country of origin branding and supporting the Australian Made, Australian Grown (AMAG) logo in domestic and export markets, thereby facilitating Australian businesses in expanding their export activities. The primary objective of this instrument is to prescribe the Australian Made Export Initiative Program, which provides funding for activities aimed at promoting the AMAG logo and related export education and business development programs. The powers specified in this instrument include the Parliament's authority to legislate concerning trade and commerce with other countries and external affairs, as outlined in the Constitution. The Instrument was initially enacted as the Industry Research and Development (Australian Made Export Campaign Program) Instrument 2019 and was subsequently amended to its current form, the Industry Research and Development (Australian Made Export Initiative Program) Instrument 2019, on 10 July 2025. This amendment aimed to refine the program's focus and better support Australian businesses in leveraging the AMAG logo for export growth. The details of the legislative history and amendments are available in the endnotes of this compilation, which provide comprehensive information about the amendment history and the application, saving, and transitional provisions.

Scope and Application

The Industry Research and Development (Australian Made Export Initiative Program) Instrument 2019, made under section 33 of the Industry Research and Development Act 1986, pertains specifically to the Australian Made Export Initiative Program. This program is designed to fund activities that enhance country of origin branding of Australian products in domestic and export markets, including the registration and enforcement of the Australian Made, Australian Grown logo trademark, its promotion, and research into its effectiveness. Additionally, the program funds related export education and business development initiatives. The instrument applies to entities or individuals involved in exporting Australian goods, as well as those responsible for the administration and oversight of the program. Jurisdictionally, the instrument operates within the Commonwealth of Australia, relying on specified legislative powers concerning trade and commerce with other countries and external affairs. The instrument does not explicitly state any exclusions or exemptions, but its provisions are subject to the overarching principles and regulations of the Industry Research and Development Act 1986. The application and scope of the instrument may be further refined or expanded through subordinate instruments or regulations made under the authority of the Act.

Key Provisions

The Industry Research and Development (Australian Made Export Initiative Program) Instrument 2019 (sections 1-6) establishes a program under the Industry Research and Development Act 1986. Section 5 specifies that the program provides funding to enhance country of origin branding in domestic and export markets, including activities related to the registration, enforcement, and promotion of the Australian Made, Australian Grown (AMAG) logo, and research into the effectiveness of the logo. Section 5 also outlines funding for related export education and business development programs. The instrument also defines the program as prescribed under section 33(1) of the Act and specifies the legislative power under sections 33(3) and 51(i) and (xxix) of the Constitution. The obligations imposed by the instrument on parties and entities include the requirement to use the funds provided under the program for the purposes specified in section 5. This includes activities aimed at enhancing the AMAG logo's effectiveness and visibility in both domestic and export markets, as well as supporting export education and business development programs. The entities receiving funding must ensure that their activities align with the objectives of the program and comply with any additional terms or conditions imposed by the relevant authorities. Failure to comply with the requirements of the program or misuse of funds may result in various consequences. Under the Industry Research and Development Act 1986, breaches of the Act or its regulations may lead to civil penalties, including fines. The maximum penalty for contravening certain provisions can be substantial, reflecting the seriousness of non-compliance. Additionally, criminal penalties may apply in cases of wilful or reckless disregard for the Act's provisions, potentially leading to imprisonment. The exact penalties depend on the specific provision breached and the circumstances of the offence.
