Overview

The Indian Ocean Territories Administration Values and Code of Conduct 2018 was enacted to establish the values and conduct standards for employees of the Indian Ocean Territories Administration. This determination, made by Karly Pidgeon, the delegate of the Minister for Regional Development, Territories, and Local Government, was introduced to ensure that employees uphold the highest standards of professionalism, integrity, and accountability in their roles. The legislation revokes the previous Christmas Island Administration Determination 2001/2 and sets forth a new framework for the conduct of Administration employees. By clearly outlining the values and code of conduct, the Act aims to foster an environment of ethical behaviour, respect, and accountability within the Administration, ultimately ensuring that it serves the best interests of the Australian community and the Government.

Scope and Application

The Indian Ocean Territories Administration Values and Code of Conduct 2018 applies to all employees of the Indian Ocean Territories Administration, encompassing those employed under subsection 11(1) of the Administration Ordinance 1968 (CI) and paragraph 10(1)(b) of the Administration Ordinance 1975 (CKI). This legislation establishes the standards and ethical guidelines that these employees must adhere to in their professional conduct and interactions. The scope of this Act is specifically directed towards the professional and ethical behaviour of employees within the administration, ensuring that they act with honesty, integrity, and diligence, and comply with all applicable Australian laws. The Act also mandates that employees treat everyone with respect and courtesy, avoid conflicts of interest, maintain confidentiality, and behave in a manner that upholds the values and reputation of the Administration and Australia. The application of this Act is exclusive to the Indian Ocean Territories Administration employees, with no broader jurisdictional reach mentioned beyond the specified territories.

Key Provisions

The Indian Ocean Territories Administration Values and Code of Conduct 2018 (the Determination) sets out the core values and expected standards of conduct for employees of the Indian Ocean Territories Administration. It commenced on 3 April 2018 and applies to all Administration employees (sections 2, 6). The Determination was made under the Administration Ordinance 1968 (CI) and Administration Ordinance 1975 (CKI) (section 3). The Determination outlines the Indian Ocean Territories Administration's values of being committed to service, ethical, respectful, accountable, and impartial (Schedule 1). It also sets out a code of conduct with rules that Administration employees must adhere to, such as behaving honestly, acting with care and diligence, treating others with respect, complying with laws, avoiding conflicts of interest, and maintaining confidentiality (Schedule 2). Administration employees are required to uphold the Determination's values and code of conduct (section 7). The Determination imposes obligations on Administration employees to conduct themselves in a professional manner that reflects the Administration's values and abides by the rules in the code of conduct. This includes behaving with integrity, avoiding conflicts of interest, maintaining confidentiality, complying with laws, and using resources appropriately. Failure to comply with the Determination may have legal consequences. The Determination does not explicitly state any offences, penalties or consequences for breach. However, violating the rules in the code of conduct or failing to uphold the values could potentially constitute misconduct or breach of employment terms, which may result in disciplinary action or termination of employment.
