AUSTRALIAN TAXATION OFFICE
STUDENT ASSISTANCE ACT 1973
Indexation factor for working out accumulated Financial Supplement debts
I, CHRISTINE WINKLER, of the Australian Taxation Office, HEREBY NOTIFY, pursuant to subsection 12ZF(7A) of the Student Assistance Act 1973, that 1.026 is the indexation factor calculated under subsection 12ZF(6) of that Act that is applicable in working out any Financial Supplement and accumulated Financial Supplement debts of a person on 1 June 2014.
In accordance with subsection 12ZF(6) of the Student Assistance Act 1973, the indexation factor is the number worked out to three decimal places using the formula:
the sum of the index number for the March 2014 quarter and the index numbers for the three immediately preceding quarters
divided by
the sum of the index number for the March 2013 quarter and the index numbers for the three immediately preceding quarters,
where index number, in relation to a quarter, means the All Groups Consumer Price Index number, being the weighted average of the eight capital cities, published by the Australian Statistician in respect of that quarter.
Indexation factor for 1 June 2014 = Mar14+Dec13+Sep13+Jun13
Mar13+Dec12+Sep12+Jun12
= 105.4 + 104.8 + 104.0 + 102.8
102.4 + 102.0 + 101.8 + 100.4
= 417 divided by
406.6
= 1.026 (to three decimal places)
The indexation factor is 1.026 and the effective percentage increase is 2.6%.

Overview
The Australian Taxation Office Student Assistance Act 1973 was enacted to provide for the recovery of student assistance provided by the Commonwealth, and to establish the Australian Education Debt Management System. This Act was introduced to address the need for a structured and effective mechanism to recover student assistance and manage student debts. The policy objective of the Act is to ensure that financial assistance provided to students is appropriately managed and repaid in a fair and systematic manner. The indexation factor notification under this Act aims to adjust the accumulated Financial Supplement debts based on the changes in the Consumer Price Index, ensuring that the repayment amounts are reflective of the current economic conditions. The notification by Christine Winkler, on behalf of the Australian Taxation Office, indicates the indexation factor applicable for June 1, 2014, which was calculated based on the specified formula using the relevant Consumer Price Index numbers.
Scope and Application
The Australian Taxation Office Student Assistance Act 1973 applies to individuals who have accumulated Financial Supplement debts in relation to student assistance, which are indexed to reflect changes in the cost of living. The Act specifies the calculation of the indexation factor used to determine these debts, ensuring that they are adjusted for inflation on a specific date. The indexation factor for 1 June 2014, as calculated under the provisions of the Act, is 1.026, reflecting a 2.6% increase. This legislation has a national reach within Australia, impacting all individuals subject to the Act regardless of their state or territory. There are no specific exclusions or exemptions mentioned within the notification, though the Act itself may contain provisions that exclude certain individuals or categories from its application. The Act's scope is extended through the use of subordinate instruments that may further define or specify the application of the indexation factor in various contexts.
Key Provisions
The Australian Taxation Office Student Assistance Act 1973 (the "Act") contains several key sections relevant to the calculation of Financial Supplement debts. Under section 12ZF, the Act specifies that the indexation factor for determining the accumulated Financial Supplement debts of a person as at 1 June 2014 is 1.026 (subsection 12ZF(7A)). This indexation factor is calculated using the formula provided in subsection 12ZF(6), which involves the sum of the index numbers for the March 2014 quarter and the three preceding quarters, divided by the sum of the index numbers for the March 2013 quarter and the three preceding quarters. The index numbers are derived from the All Groups Consumer Price Index, a weighted average of the eight capital cities published by the Australian Statistician. This calculation results in an effective percentage increase of 2.6%.
The Act imposes specific obligations on the Australian Taxation Office (ATO) to determine and notify the indexation factor applicable for calculating Financial Supplement debts. Under subsection 12ZF(7A), the ATO must notify the indexation factor that applies as of 1 June of each year, ensuring that it is calculated accurately and in accordance with the formula provided in subsection 12ZF(6). This notification is a critical step in ensuring that the indexation factor is applied correctly in the calculation of any debts related to the Financial Supplement, thus maintaining the accuracy and fairness of the financial assessments.
In the event of a breach of the Act's provisions, there are no explicit offences, penalties, or civil/criminal consequences outlined in the gazetted notification. The focus of the notification is on providing accurate information for the calculation of Financial Supplement debts, rather than on punitive measures. However, it is important to note that any inaccuracies in the calculation or application of the indexation factor could potentially lead to disputes or legal challenges regarding the fairness and accuracy of the Financial Supplement debts. As such, the ATO is obligated to ensure that the calculations are conducted with precision and in accordance with the statutory requirements to avoid any such issues.
