Environment Protection and Biodiversity Conservation Act 1999

The Environment Protection and Biodiversity Conservation Act 1999 (the Act) places certain obligations on the Commonwealth to protect and conserve threatened species.
The purpose of this instrument is to amend the list of threatened species under the Act in accordance with s184(1)(a) of the Act by:
- adding Thelymitra sp. Kangaloon (D.L.Jones 18108) (Kangaloon Sun-orchid) to the list of threatened species in the critically endangered category.
Consultation on the nomination to amend the list of threatened species under the Act to include this species was undertaken before the legislative instrument was made. The nomination was placed on public exhibition, and public comments were sought. Parties with relevant expertise were directly consulted regarding their views.
This instrument is a legislative instrument for the purposes of the Legislative Instruments Act 2003.
The instrument commenced on the day after it was registered on the Federal Register of Legislative Instruments.

For example, section 476 of the Act provides for a maximum penalty of $500,000 or five years imprisonment, or both, for offences involving the take, injury, or killing of a listed threatened species. Section 482 of the Act provides for a maximum penalty of $220,000 or two years imprisonment, or both, for offences involving the destruction of a listed threatened species' habitat. Additionally, section 507 of the Act provides for the imposition of civil penalties for breaches of the Act, including breaches of approval or authority requirements.
