EXPLANATORY STATEMENT

 

Environment Protection and Biodiversity Conservation Act 1999

 

Instrument under section 184(1)

 

 

(Issued under the Authority of the Minister for the Environment and Heritage)

 

The Environment Protection and Biodiversity Conservation Act 1999 (the Act) places certain obligations on the Commonwealth to protect and conserve threatened species and ecological communities, and recognise, and where possible, abate key threatening processes listed on the list of threatened species, ecological communities and key threatening processes under the Act. 

 

The purpose of this instrument is to amend the list of threatened species under the Act in accordance with s184 by adding Lepidium ginninderrense (Ginninderra Peppercress) to the list of vulnerable species as recommended by the Threatened Species Scientific Committee (the Committee), having regard to the definition of vulnerable in s179(5) of the Act.

 

The Committee’s recommendations are as follows:

 

  1. Lepidium ginninderrense (Ginninderra Peppercress)

The evidence presented in the nomination and submitted by experts in the field enabled the Committee to judge that Lepidium ginninderrense is eligible for listing as vulnerable under the Act.  The species met the criteria in the Act and EPBC Regulations (Part 7, Division 7.1 and 7.2).  In particular, one of the criteria for listing as vulnerable has been met.  This is:

 

Criterion 4:  The estimated total number of mature individuals is low.

 

On this basis, the Committee recommends that the species be listed as vulnerable under the Environment Protection and Biodiversity Conservation Act 1999.

 

On the basis of the advice of the Committee, I am satisfied that Lepidium ginninderrense is eligible to be included in the vulnerable category.

 

In deciding to include this species in the list, I did not consider any matter that does not relate to the survival of this species.

 

This instrument is a legislative instrument for the purposes of the Legislative Instruments Act 2003.

 

The instrument commenced on the day after it was registered on the Federal Register of Legislative Instruments.

Overview

The Environment Protection and Biodiversity Conservation Act 1999 was enacted to address the need for comprehensive protection and conservation of Australia's threatened species and ecological communities, and to recognise and mitigate key threatening processes that endanger these species and communities. The Act imposes obligations on the Commonwealth to ensure the preservation of biodiversity and ecological integrity, and it provides a framework for the identification and management of species and processes that are at risk. This legislative instrument, issued under the authority of the Minister for the Environment and Heritage, aims to amend the list of threatened species by adding Lepidium ginninderrense (Ginninderra Peppercress) to the category of vulnerable species. This addition follows the recommendations of the Threatened Species Scientific Committee, which assessed the species based on specified criteria, including the estimated number of mature individuals, and concluded that Lepidium ginninderrense meets the conditions for vulnerability under the Act. The instrument serves to implement the policy objective of protecting biodiversity by recognising and safeguarding species that are at significant risk of extinction.

Scope and Application

The Environment Protection and Biodiversity Conservation Act 1999 (the Act) applies to the protection and conservation of threatened species and ecological communities across Australia, with a particular emphasis on species listed under the Act. This Act imposes obligations on the Commonwealth to safeguard these species and communities, and to mitigate the impact of key threatening processes where possible. It encompasses a broad range of entities, including individuals, corporations, and government bodies, and applies to conduct and transactions that may impact listed species or ecological communities. The geographic scope of the Act is national, as it extends to all of Australia, including its territories, and seeks to provide a cohesive framework for environmental protection and biodiversity conservation. However, the Act does not apply to matters that are explicitly excluded, such as certain activities related to state and territory land or activities conducted under state and territory laws, unless they are specifically referred to the Commonwealth for assessment. The Act also allows for amendments through subordinate instruments, such as the one described, which updates the list of threatened species in accordance with recommendations from the Threatened Species Scientific Committee. This particular instrument adds Lepidium ginninderrense (Ginninderra Peppercress) to the list of vulnerable species, reflecting the scientific assessment of its conservation status under the criteria set out in the Act.

Key Provisions

The Environment Protection and Biodiversity Conservation Act 1999 (the Act) mandates the Commonwealth to protect and conserve threatened species and ecological communities. One of the main operative sections relevant to this legislation is section 184(1), which allows for amendments to the list of threatened species under the Act. Specifically, this instrument amends the list of threatened species by adding Lepidium ginninderrense, also known as Ginninderra Peppercress, to the list of vulnerable species (s184). This recommendation was made considering the survival of the species and no other extraneous matters (s184). The Act imposes obligations on the Commonwealth to protect and conserve species listed as vulnerable. For Lepidium ginninderrense, this means that the Commonwealth must implement measures to ensure its survival, such as habitat protection, management plans, and monitoring programs. Additionally, any actions that may threaten the species' survival must be carefully assessed and mitigated where possible. Failure to comply with the Act's provisions may result in civil and criminal penalties. Under the Act, breaches of its provisions can lead to significant fines and, in some cases, imprisonment. For example, unauthorised actions that harm listed species can incur penalties of up to AUD 5.5 million for corporations and AUD 1.1 million for individuals, along with potential imprisonment terms. The Act also allows for the imposition of civil penalties for breaches of its provisions, which can include fines up to AUD 66,600 per offence for corporations and AUD 13,320 for individuals. In summary, the legislative instrument amends the list of threatened species by adding Lepidium ginninderrense to the vulnerable category, based on scientific recommendations. The Act imposes obligations on the Commonwealth to protect this species, with potential civil and criminal consequences for non-compliance.
