Subject: REGULATIONS - HUMAN RIGHTS COMMISSION ACT 1981
Sub-section 21(2) of the Human Rights Commission Act 1981 provides that a member of the Human Rights Commission shall be paid such allowances as are prescribed. Sub-section 21(3) states that sub-section 21(2) has effect subject to the Remuneration Tribunals Act 1973.
The remuneration and travelling allowance payable to members of the Human Rights Commission is covered by Determinations made by the Remuneration Tribunal from time to time.
No allowances have previously been prescribed under sub-section 21(2) of the Act.
The purpose of the Human Rights Commission (Allowances) Regulations is to extend to persons appointed as members of the Commission those allowances payable from time to time to officers in the Australian Public Service. With most Public Service Regulations relating to the payment of allowances being progressively replaced by Public Service Board determinations, these regulations will also extend to members of the Commission the benefits of the Public Service Board determinations.

Section 35 of the Human Rights Commission Act 1981 provides that the Governor-General may make regulations, not inconsistent with the Act, prescribing all matters that are required or permitted by the Act to be prescribed or are necessary or convenient to be prescribed for carrying out or giving effect to the Act.
