The primary objective of this legislation is to address the need for qualified and experienced individuals to contribute to the governance and strategic direction of Housing Australia, ensuring effective policy implementation and oversight within the housing sector. The appointment was made under the authority granted by subsection 18(1) of the Act and took effect from the day after the instrument was registered on 13 December 2024.

Scope and Application

The Notifiable Instrument F2024N01158 pertains to the appointment of Damien Tangey as a part-time member of the Housing Australia Board. This appointment is made under the authority conferred by subsection 18(1) of the Housing Australia Act 2018, with Clare O’Neil, the Minister for Housing and the Minister for Homelessness, being satisfied of the criteria outlined in subsection 18(2) of that Act. The term of appointment lasts for five years, starting from the day after the instrument is registered. The scope of the appointment extends to the individual, Damien Tangey, and the specific role he is to undertake within the Housing Australia Board, without extending to other entities or industries unless otherwise specified by the Board’s charter or related regulations. The jurisdictional reach of this instrument is governed by the Commonwealth, with its application confined within the legislative and regulatory framework established by the Commonwealth of Australia. There are no stated exclusions, exemptions, or thresholds within the instrument itself, though any such provisions would typically be found in the broader legislative context of the Housing Australia Act 2018. The application of the Act may be further defined or restricted by subordinate instruments or regulations, which are not detailed in this particular notifiable instrument.

Key Provisions

The primary operative sections of this notifiable instrument (F2024N01158) concern the appointment of Damien Tangey as a part-time member of the Housing Australia Board, effective for a period of five years. According to the instrument, this appointment is made under subsection 18(1) of the Housing Australia Act 2018, with Clare O’Neil, the Minister for Housing and Minister for Homelessness, satisfied that the conditions outlined in subsection 18(2) of that Act have been met (subsection 18(1) and subsection 18(2)). The instrument specifies that the appointment will commence on the day after the signed instrument is registered, which is dated 13 December 2024. The obligations and requirements imposed by this legislation primarily involve the appointed member, Damien Tangey, and the Housing Australia Board. As a member of the Board, Damien Tangey will be expected to fulfil his duties in a part-time capacity over the five-year term. This includes participating in Board meetings, contributing to strategic decision-making processes, and ensuring compliance with the objectives and policies set forth by the Housing Australia Act 2018. The Board, in turn, is obligated to provide Tangey with the necessary resources and support to effectively perform his duties. In terms of legal consequences, breaches of the obligations outlined in the instrument could lead to various civil or administrative penalties. For instance, if Damien Tangey fails to discharge his duties in accordance with the Act, the Board or the Minister could seek to have him removed from his position. There are no explicitly stated maximum penalties in the instrument itself, but any breach of the legislative framework under which the Board operates could result in legal action, including potential disciplinary measures or other consequences as prescribed by the Housing Australia Act 2018.
