Overview

The Housing Australia Future Fund Act 2023 was enacted to address a critical need for a robust, long-term funding mechanism dedicated to supporting the affordability and availability of housing in Australia. The Act establishes the Housing Australia Future Fund, which aims to provide a sustainable source of funding to meet future housing needs, particularly in response to demographic changes and economic pressures. The policy objective is to ensure that the fund provides for the needs of Australians in a manner that is both financially prudent and responsive to the evolving housing market. The Act was proclaimed into force by the Honourable David Hurley AC DSC (Retd), the Governor-General, acting with the advice of the Federal Executive Council, and the commencement date was set as 1 November 2023. This legislative action is pivotal in formalising the establishment of the Housing Australia Future Fund, thereby addressing the legislative gap in long-term housing finance. The Act was signed and sealed with the Great Seal of Australia on 16 October 2023 by the Governor-General, David Hurley, by His Excellency's Command, under the authority of Katy Gallagher, the Minister for Finance.

Scope and Application

The Housing Australia Future Fund Act 2023 applies to the establishment and operation of the Housing Australia Future Fund, which is an entity created by the Commonwealth of Australia to support the provision of affordable housing and address housing affordability issues across the nation. The Act applies to the Fund itself as an entity, and to individuals and entities involved in the administration, governance, and investment activities of the Fund. This includes trustees, directors, employees, and relevant stakeholders within the housing sector. The Act sets out the legal framework within which the Fund can operate, including the management of its assets and liabilities, the governance structure, and the investment strategies it may pursue. The jurisdictional reach of the Act is national, as it pertains to a Commonwealth initiative, thereby impacting housing policies and funding mechanisms across Australia. The Act does not explicitly detail exclusions, exemptions, or specific thresholds within the proclamation text itself. However, it is anticipated that the full Act will provide further clarification on any limitations or exceptions applicable to the Fund's operations. The Act may also extend or restrict its application through subordinate instruments, such as regulations or guidelines, which would be developed to further define the operational aspects of the Fund. These subordinate instruments would be essential in detailing the specific mechanisms through which the Fund interacts with other entities and complies with broader financial and regulatory standards.

Key Provisions

The Housing Australia Future Fund Commencement Proclamation 2023 (No. 1) sets the commencement date for the Housing Australia Future Fund Act 2023, which is 1 November 2023. This means that from this date, all the provisions of the Act will come into effect and be legally binding (s 1). The Act itself, once commenced, is expected to establish a fund aimed at ensuring a sustainable housing future for Australians, with provisions for its governance, funding, and use. Under the Act, the key obligations imposed on the parties involved include the establishment of the Housing Australia Future Fund and the appointment of a Board to govern it. The Board will be responsible for managing the Fund’s investments and ensuring that the Fund’s activities align with its objectives. Additionally, the Act will require the Treasurer to provide annual reports to Parliament on the Fund's activities, finances, and performance (s 5, s 6). The Minister for Finance, currently Katy Gallagher, has a role in overseeing the implementation of the Act and ensuring compliance with its requirements. Breaching the provisions of the Housing Australia Future Fund Act 2023 may lead to both civil and criminal consequences. While the specific offences and penalties are not detailed in the Proclamation, breaches of similar legislative instruments generally incur fines or imprisonment. For instance, under the Corporations Act 2001, civil penalties can reach up to $210,000 for individuals and $1,050,000 for bodies corporate for breaches involving dishonesty. Criminal penalties, which can also apply in cases of serious misconduct, may include fines and imprisonment terms that vary depending on the severity of the breach. It is expected that the Act will include comparable provisions to ensure its effective enforcement.
