Overview

The Higher Education Support (Maximum Grant Amounts) List Variation 2013 was introduced to amend the list of maximum funding amounts for grants under the Higher Education Support Act 2003. This legislative instrument updates the maximum amounts of various grants, addressing the need for adjustments due to budget measures and changes in project payments for the 2013 calendar year. The Minister for Education, acting under the authority of Subsection 41-50(1) and (2) of the Act, has the power to vary the list of grants before the end of the year, and this particular variation aims to accommodate shifts in funding allocations for several programs, including the Higher Education Participation and Partnership Program, the National Institutes Program, the Structural Adjustment Fund, and Reward Funding. The variation reflects changes necessitated by budget provisions and project delays, thereby ensuring that the higher education sector receives the necessary financial support. The policy objective of this legislative instrument is to enhance the accessibility and quality of higher education by ensuring that the funding provided aligns with the current needs and priorities of the sector. By increasing the maximum grant amounts for specific programs, the instrument seeks to promote equality of opportunity in higher education, support diversity and structural reform, bolster national institutes, and ensure the enhancement of quality. This legislative update is deemed compatible with human rights, particularly the right to education as outlined in Article 13 of the International Covenant on Economic, Social and Cultural Rights, by facilitating access to education and supporting the sector's initiatives.

Scope and Application

The Higher Education Support (Maximum Grant Amounts) List Variation 2013 pertains to the administration of grants under the Higher Education Support Act 2003, specifically updating the maximum amounts of grants that can be paid for the 2013 calendar year. This legislation applies to the Commonwealth government, particularly the Minister for Education, who is responsible for preparing and varying the list of maximum grant amounts annually. The Act impacts various stakeholders within the higher education sector, including educational institutions, funding recipients, and potentially students and their families, by influencing the financial support available for higher education programs and projects. The scope of this legislation is national, as it falls under the purview of the Commonwealth government. There are no exclusions or exemptions specified within the text, and the application of the Act is straightforward, with no indication of extension or restriction through subordinate instruments. The Legislative Instrument is compatible with human rights, particularly the right to education, as it facilitates increased funding and access to higher education opportunities.

Key Provisions

The Higher Education Support (Maximum Grant Amounts) List Variation 2013, pursuant to the Higher Education Support Act 2003, outlines updates to the maximum funding amounts for certain grants. These amendments are made under section 41-50(2) of the Act, allowing the Minister to vary the list of maximum amounts before the end of the fiscal year (subsections 41-50(1) and 41-50(2)). Specifically, the legislative instrument increases the maximum grant amounts for the Higher Education Participation and Partnership Program by $18.2 million, the National Institutes Program by $1.4 million, the Structural Adjustment Fund by $7.7 million, and Reward Funding by $7.2 million (Schedule 1). These increases are reflected in items 1, 4, 9B, and 11(a) of the List of Grants under Division 41. The obligations imposed by the Act require the Minister to prepare a list detailing the maximum amounts of grants that can be paid in the following year for each specified purpose, as detailed in section 41-10 of the Act (subsection 41-50(1)). This list must be updated annually and can be varied before the end of the year if necessary (subsection 41-50(2)). The Minister has exercised this authority by issuing the Higher Education Support (Maximum Grant Amounts) List Variation 2013, ensuring that the funding amounts are adjusted to reflect budgetary changes and shifts in project timelines. The legislation does not explicitly outline specific offences or penalties for breaches of the Act. However, the failure to adhere to the updated grant amounts or the obligations stipulated in the Act could lead to broader administrative and financial repercussions, including potential legal actions for non-compliance with governmental directives. The maximum penalties for such breaches are not specified within the instrument itself but would be determined by the overarching framework of the Higher Education Support Act 2003. Overall, the Higher Education Support (Maximum Grant Amounts) List Variation 2013 ensures that the funding for higher education initiatives is appropriately adjusted to meet the needs of the sector. This legislative instrument aligns with human rights by enhancing access to education through increased funding, thereby supporting the principles of equality and diversity in higher education.
