Overview
The Higher Education Support (Indigenous Student Success Program) (Rollover of Grant Amounts) Amendment Determination 2023 was enacted to address discrepancies in the rollover of grant amounts for the Indigenous Student Success Program (ISSP) for the year 2022. This amendment was introduced by Stephen Baz, acting as a delegate of the Chief Executive Officer of the National Indigenous Australians Agency, under the authority granted by subsections 38-40(3) and 38-40(4) of the Higher Education Support Act 2003. The purpose of this determination is to adjust the unspent grant amounts for certain higher education providers and ensure the accurate allocation of funds to support Indigenous student success, aligning with the policy objectives outlined in Part 2-2A of the Higher Education Support Act 2003. The amendments correct specific amounts and activities related to the rollover of the 2022 ISSP grants, thereby ensuring that resources are appropriately directed to meet the program’s goals.
Scope and Application
The Higher Education Support (Indigenous Student Success Program) (Rollover of Grant Amounts) Amendment Determination 2023 applies to the unspent grant amounts from the Indigenous Student Success Program (ISSP) for the year 2022 and their rollover into 2023. This determination amends the Higher Education Support (Indigenous Student Success Program) (Rollover of Grant Amounts) Determination 2023, specifically targeting the amounts for certain higher education providers and modifying activities related to the 2023 ISSP grants. The amendment affects designated higher education institutions by adjusting the amounts of unspent grants that can be carried over and specifying new activities for the grant usage, such as Indigenous student engagement and well-being. This instrument is made under the authority of the Higher Education Support Act 2003 and comes into effect following its registration. The amendments are detailed in the Schedule to this determination, which also includes conditions for using the grants as specified in the original determination.
Key Provisions
The Higher Education Support (Indigenous Student Success Program) (Rollover of Grant Amounts) Amendment Determination 2023 (section 1) amends the Higher Education Support (Indigenous Student Success Program) (Rollover of Grant Amounts) Determination 2023. This instrument commences on the day after its registration (section 2). It is made under subsections 38-40(3) and 38-40(4) of the Higher Education Support Act 2003 (section 3), and amends the specified instruments according to their schedules (section 4).
This determination modifies the amounts of unspent grants from the 2022 Indigenous Student Success Program (ISSP) that can be carried over to the 2023 program for certain universities (Schedule 1, section 5). For example, Charles Sturt University's unspent grant amount changes from $174,922 to $159,636.54. Additionally, it updates the amount of unspent 2022 ISSP rollover grants for La Trobe University from $150,000 to $526,137 (Schedule 1, section 6). Furthermore, it specifies new activities for the use of the 2023 ISSP further rollover grant for La Trobe University, including Indigenous Student engagement and well-being (Schedule 1, section 1, item 15).
The obligations imposed by this determination require the specified higher education providers to adhere to the amended grant amounts and conditions. For instance, Charles Sturt University must now manage $159,636.54 instead of $174,922 for the rollover of 2022 ISSP grant amounts. Similarly, La Trobe University must now allocate $526,137 instead of $150,000 for the rollover of 2022 ISSP grant amounts and must use part of its 2023 ISSP further rollover grant for Indigenous Student engagement and well-being. These obligations ensure that the funds are used in accordance with the updated determination.
There are no explicit offences or penalties mentioned in the text of this determination. However, failure to comply with the conditions set out in the Higher Education Support Act 2003 or the amended determination could result in consequences such as the recovery of funds or other administrative actions taken by the relevant authorities. The specific penalties would depend on the nature and severity of the breach, as outlined in the Higher Education Support Act 2003.
