The Higher Education Support (Indigenous Student Success Program) (Rollover of Grant Amounts) Amendment Determination 2022, made by the Delegate of the Chief Executive Officer, Stephen Baz, from the National Indigenous Australians Agency, amends the amounts of unspent Indigenous Student Success Program (ISSP) grant rollovers for certain institutions and modifies specific activities related to the grants. This instrument, which comes into effect after registration, is authorised under subsections 38-40(3) and 38-40(4) of the Higher Education Support Act 2003 and serves to update the Higher Education Support (Indigenous Student Success Program) (Rollover of Grant Amounts) Determination 2022. The determination rectifies specific amounts and activities for the rollover of ISSP grants, ensuring that the funds are allocated correctly and activities are aligned with the intended purposes of the grants.

Scope and Application

The Higher Education Support (Indigenous Student Success Program) (Rollover of Grant Amounts) Amendment Determination 2022 applies to specific institutions and their Indigenous Student Success Program (ISSP) grants under the Higher Education Support Act 2003. This determination amends the grant amounts and conditions for rollover of unspent funds, particularly affecting universities such as Victoria University, Queensland University of Technology, The University of Queensland, The University of Newcastle, and the University of Wollongong. The amendments include adjustments to the amounts of unspent ISSP grants and changes to the activities these funds can support. This amendment determination is applicable on a national level, as it pertains to institutions across different states and territories within Australia. It is important to note that this determination does not create new grants but modifies existing ones, and the changes are effective as per the specified amendments in the schedule.

Key Provisions

The Higher Education Support (Indigenous Student Success Program) (Rollover of Grant Amounts) Amendment Determination 2022 ((F2022N00266)) amends the Higher Education Support (Indigenous Student Success Program) (Rollover of Grant Amounts) Determination 2022. This amendment determination modifies the amount of unspent Indigenous Student Success Program (ISSP) grants for certain institutions and alters the activities that must be undertaken with these grants. For example, the amount of unspent grant for Victoria University has been amended from $98,495.90 to $156,237.19 (Schedule 1, Item 25). Additionally, the activities for The University of Newcastle and the University of Wollongong have been updated to include "student engagement activities" (Schedule 1, Items 27 and 28). These amendments are effective from the day after the determination is registered. Under this determination, institutions receiving an ISSP rollover grant must adhere to the specified grant amounts and activities as outlined in the amended tables. They must ensure that the funds are used for the activities specified in the determination, and any changes to the use of funds require prior approval. Institutions are also required to report on the use of these funds to the National Indigenous Australians Agency in accordance with the conditions set out in the Higher Education Support (Indigenous Student Success Program) (Rollover of Grant Amounts) Determination 2022. Failure to comply with the requirements of this determination may result in the recovery of funds by the Commonwealth or other civil or criminal consequences, as outlined in the Higher Education Support Act 2003. The specific penalties for non-compliance are not detailed in the amendment determination but may include financial penalties or legal action depending on the nature and severity of the breach. The amendment determination provides specific amendments to the grant amounts and activities for certain institutions. It imposes obligations on these institutions to use the funds as specified and to report on their use of the grants. While the exact penalties for non-compliance are not detailed in the determination, they could include financial penalties or legal action under the relevant Act.
