Overview

The Higher Education Support (Approval of Asia Pacific International College Pty Ltd) Approval 2021 is an instrument enacted to address the need for the Minister for Education and Youth to approve a body corporate as a higher education provider under the Higher Education Support Act 2003. This approval process is mandated by subsection 16-25(1) of the Act, which requires the Minister to be satisfied that the applicant meets certain requirements, including submitting an application under section 16-40. The approval process includes the notification of the applicant in writing regarding their status as a higher education provider. The approval of Asia Pacific International College Pty Ltd as a higher education provider aims to make the institution eligible for certain grants and financial assistance for its students from the Commonwealth. The Minister has imposed specific conditions on this approval, such as maintaining adequate liquidity and financial reporting requirements, to ensure the institution's viability and compliance with the Act. This legislative instrument was issued by the authority of the Minister for Education and Youth under the Higher Education Support Act 2003. The policy objective of this approval is to promote access to higher education by ensuring that eligible institutions can receive necessary financial support, thereby facilitating educational opportunities for students. The approval of Asia Pacific International College Pty Ltd as a higher education provider aligns with the overarching goal of the Act to support higher education institutions and their students through various financial and regulatory frameworks.

Scope and Application

The Higher Education Support (Approval of Asia Pacific International College Pty Ltd) Approval 2021 is a legislative instrument issued under the Higher Education Support Act 2003, authorising Asia Pacific International College Pty Ltd as a higher education provider. This approval allows the College to be eligible for certain grants made under the Act and ensures that its students can access financial assistance from the Commonwealth. The approval process involves specific conditions that Asia Pacific International College Pty Ltd must adhere to, including maintaining adequate liquidity levels, ensuring a positive equity position, and providing annual financial information to the relevant department. These conditions are designed to uphold the College's financial viability and its ability to meet quality and accountability requirements. The Minister for Education and Youth has the authority to vary or revoke these conditions as necessary. The Instrument is compatible with human rights, particularly promoting the right to education as outlined in the International Covenant on Economic, Social and Cultural Rights.

Key Provisions

The Higher Education Support (Approval of Asia Pacific International College Pty Ltd) Approval Instrument 2021 primarily focuses on the approval of Asia Pacific International College Pty Ltd as a higher education provider under the Higher Education Support Act 2003. Section 5 of the Instrument confirms the approval of the College as a higher education provider, thereby making it eligible to receive certain grants and allowing its students to access financial assistance from the Commonwealth. This approval is contingent upon the College meeting the specified requirements and conditions as outlined in the Act and the Instrument. Under the Act, the College must meet stringent conditions to maintain its approval status. These conditions include maintaining adequate liquidity levels, ensuring a positive equity position, and refraining from providing financial guarantees or loans to directors or related entities that could materially affect its financial stability (sections 16-60 and 16-65). The College is also obligated to provide annual financial reports and notify the department of any significant changes, regulatory activities, or events that could impact its capacity to meet the Act's quality and accountability requirements (section 16-60). Such conditions are intended to ensure the financial and operational integrity of the College. Failure to comply with the conditions of approval may lead to severe consequences. Under the Act, the Minister has the authority to vary or revoke the conditions of approval and can do so without prior notice, subject to the College being informed within 30 days of such a decision (subsection 16-60). Non-compliance with the stipulated conditions could potentially lead to the revocation of the College's approval as a higher education provider, which would disqualify it from receiving grants and bar its students from Commonwealth financial assistance. Additionally, persistent non-compliance might result in further regulatory scrutiny or legal action.
