Overview

The Higher Education Support Act 2003 was enacted to provide a framework for the regulation of the higher education sector in Australia, including vocational education and training (VET) providers. To address the need for a streamlined and transparent process for approving VET providers under the VET FEE-HELP Assistance Scheme, the Minister for Education issued the Approval and Notice of Approval under subclauses 6(1) and 11(1) of Schedule 1A to the Higher Education Support Act 2003. This instrument was introduced to approve specific entities as VET providers, enabling them to offer VET FEE-HELP assistance to their eligible students. The approval process ensures that only qualified bodies can participate in the scheme, thereby maintaining the integrity and effectiveness of the VET FEE-HELP program. The instrument is compatible with human rights, particularly the right to education, as it allows eligible students to access VET FEE-HELP assistance, thereby promoting access to vocational education and training.

Scope and Application

The Explanatory Statement outlines the legislative instrument that approves Australian College of Finance Pty Limited as a VET Provider under subclause 6(1) of Schedule 1A to the Higher Education Support Act 2003. This approval allows the entity to offer VET FEE-HELP assistance to its eligible students for vocational education and training courses such as diplomas and graduate certificates. The approval process requires the Minister for Education to be satisfied that the applicant meets the specified criteria, and once approved, the entity is notified in writing. The Minister has delegated the power to approve VET providers to an Australian Public Service employee responsible for administering the Act. The legislative instrument takes effect on the day after it is registered on the Federal Register of Legislative Instruments. The approval process engages the right to education as outlined in Article 13 of the International Covenant on Economic, Social, and Cultural Rights, which the Instrument promotes by enabling eligible students to access VET FEE-HELP assistance. The legislative instrument applies specifically to Australian College of Finance Pty Limited, a body corporate that is also a Registered Training Organisation, seeking approval as a VET Provider. The approval process and the subsequent offering of VET FEE-HELP assistance are conducted within the framework of the Higher Education Support Act 2003 and are subject to the requirements set out in Schedule 1A. The instrument's impact is limited to the entity itself, and no consultation was deemed necessary as it neither directly nor substantially indirectly affects business or competition. The approval is a national measure within the Commonwealth jurisdiction, extending the availability of VET FEE-HELP assistance to eligible students of the approved entity.

Key Provisions

The key provisions of this legislation relate to the approval of a body corporate as a VET Provider under the Higher Education Support Act 2003 (the Act) (subclause 6(1) and paragraph 11(1)(a) of Schedule 1A). The legislation also covers the notification of the Minister's decision to the applicant (paragraph 11(1)(b) of Schedule 1A) and the classification of the notice of approval as a legislative instrument (subclause 12(1) of Schedule 1A). Specifically, this legislation approves Australian College of Finance Pty Limited (ACN: 155 291 839 ABN: 98 155 291 839) as a VET Provider (subclause 6(1) of Schedule 1A to the Act), decides the application of Australian College of Finance Pty Limited for the purposes of paragraph 11(1)(a) of Schedule 1A to the Act, and gives Australian College of Finance Pty Limited notice of that approval for the purposes of paragraph 11(1)(b) of Schedule 1A to the Act. The obligations and requirements imposed by this legislation pertain to the approval process for bodies corporate seeking to become VET Providers. According to the Act, these bodies must meet certain criteria to be approved as VET Providers. Once approved, they can offer VET FEE-HELP assistance to their eligible students, thereby extending the availability of education and financial support to students enrolled in eligible vocational education and training courses. The legislation also mandates that the Minister, or a delegate, notify the applicant in writing of the decision to approve or decline their application (paragraph 11(1)(b) of Schedule 1A). Additionally, the notice of approval is classified as a legislative instrument (subclause 12(1) of Schedule 1A). There are no specific offences, penalties, or consequences for breach mentioned in this legislation. However, it is important to note that failure to comply with the requirements of the Higher Education Support Act 2003 or the terms and conditions of the VET FEE-HELP Assistance Scheme could potentially lead to legal action or sanctions under the relevant sections of the Act. The consequences for non-compliance may vary depending on the nature and severity of the breach. It is advisable for VET Providers to familiarise themselves with the provisions of the Act and the requirements of the VET FEE-HELP Assistance Scheme to ensure compliance and avoid any potential legal or financial repercussions.
