Authority

Subclause 6(1) of Schedule 1A to the Higher Education Support Act 2003 (the Act) provides for the approval of bodies as VET Providers by the Minister. Paragraph 11(1)(a) of Schedule 1A to the Act provides that the Minister must decide an application for approval as a VET Provider and under paragraph 11(1)(b) cause the applicant to be notified in writing whether or not the applicant is approved as a VET provider.

Under section 2385 of the Act the Minister has delegated his powers under clauses 6 and 11 of Schedule 1A to the Act to an APS employee responsible for administering the Act.

Subclause 12(1) of Schedule 1A to the Act stipulates that a notice of approval under paragraph 11(1)(b) of the Act is a legislative instrument.

Purpose

This instrument:

a. approves Southern Aviation Pty Ltd (ACN: 105 154 390 ABN: 14 105 154 390 ) as a VET Provider under subclause 6(1) of Schedule 1A to the Act;

b. decides the application of Southern Aviation Pty Ltd for the purposes of paragraph 11(1)(a) of Schedule 1A to the Act; and

c. gives Southern Aviation Pty Ltd notice of that approval for the purposes of paragraph 11(1)(b) of Schedule 1A to the Act.

Background

VET FEE-HELP is an income contingent loan scheme for the vocational education and training (VET) sector that is part of the Higher Education Loan Program (HELP).  It is an extension of the higher education FEEHELP arrangements.

VET FEE-HELP assists eligible students to pay for all or part of their VET tuition fees when studying one or more of the following eligible accredited VET courses of study: diploma; advanced diploma; graduate certificate; and graduate diploma.

In accordance with subclause 6(1) of Schedule 1A to the Act, bodies corporate that are also Registered Training Organisations (RTOs) are able to apply to become approved as a VET provider.  If approved, a VET provider will be able to offer VET FEE-HELP assistance to its eligible students.

Commencement

In accordance with subclause 12(2) of Schedule 1A to the Act and paragraph 12(1)(d) of the Legislative Instruments Act 2003, the notice and the decision to approve Southern Aviation Pty Ltd as a VET provider take effect on the day after the notice is registered on the Federal Register of Legislative Instruments.

Consultation

Consultation was not undertaken and was not considered necessary in this case because the notice confers a benefit on Southern Aviation Pty Ltd and this body is the only body affected by the notice.  This notice will not have a direct or substantial indirect effect on business, nor will it restrict competition.

Overview

The explanatory statement outlines the approval of Southern Aviation Pty Ltd as a VET provider under subclause 6(1) of Schedule 1A to the Higher Education Support Act 2003. This approval was enacted by the Minister for Education, who has delegated the relevant powers to an Australian Public Service employee. The approval allows Southern Aviation Pty Ltd to offer VET FEE-HELP assistance to eligible students studying certain accredited VET courses. The legislative instrument takes effect the day after its registration on the Federal Register of Legislative Instruments. This approval is intended to extend the availability of VET FEE-HELP assistance, thus enabling eligible students to access financial support for their vocational education and training courses. The decision to approve Southern Aviation Pty Ltd was made without consultation as it is not considered to have a substantial effect on business or competition. Furthermore, the instrument is compatible with human rights, particularly the right to education, by promoting access to vocational education and training for eligible students.

Scope and Application

The VET Provider Approval No 75 of 2013, issued under the authority of the Minister for Education, pertains to the approval of Southern Aviation Pty Ltd as a Vocational Education and Training (VET) provider under Schedule 1A of the Higher Education Support Act 2003. This legislative instrument is designed to facilitate the participation of Southern Aviation Pty Ltd in the VET FEE-HELP Assistance Scheme, enabling eligible students to receive income contingent loans for their vocational education and training costs. The approval process is governed by subclause 6(1) of Schedule 1A to the Act, which mandates that entities meeting the specified criteria can apply to become VET providers. The Minister has delegated the power to approve such applications to an Australian Public Service employee responsible for administering the Act. Once approved, Southern Aviation Pty Ltd gains the ability to offer VET FEE-HELP assistance to its students studying eligible accredited VET courses. The approval takes effect on the day following the registration of the notice on the Federal Register of Legislative Instruments. Given that the approval confers a direct benefit solely to Southern Aviation Pty Ltd and does not impose restrictions on competition or have a substantial indirect effect on business, consultation was deemed unnecessary. Additionally, the Instrument is compatible with human rights, particularly advancing the right to education by extending access to VET FEE-HELP assistance.

Key Provisions

The legislative instrument primarily focuses on the approval of Southern Aviation Pty Ltd as a VET provider under the Higher Education Support Act 2003. This approval is outlined in subclause 6(1) of Schedule 1A, which allows for the designation of bodies as VET providers by the Minister. Subclause 11(1) mandates that the Minister must decide on applications for such approval and notify the applicant in writing of the decision. Section 238-5 of the Act delegates these powers to an APS employee responsible for administering the Act. Additionally, subclause 12(1) of Schedule 1A specifies that the approval notice is a legislative instrument. The approval, decision, and notification are set forth in this instrument, which also stipulates the effective date of these actions once the notice is registered on the Federal Register of Legislative Instruments. The obligations imposed by this legislation on Southern Aviation Pty Ltd, as well as any other entities seeking similar approval, are primarily centred on meeting the criteria specified under subclause 6(1) of Schedule 1A. To gain approval, the entity must demonstrate compliance with the necessary standards and requirements, ensuring that it is equipped to offer vocational education and training services effectively. Furthermore, the entity must be a Registered Training Organisation (RTO) and must have applied for approval in accordance with the provisions of the Act. The Minister, or the designated APS employee, must then review the application and ensure that all stipulated conditions are met before proceeding with the approval process. The Act does not explicitly detail specific offences or penalties for non-compliance in this context. However, it is reasonable to infer that any failure to meet the criteria for approval or any subsequent non-compliance with the conditions of the approval could potentially lead to revocation of the approval. This revocation could, in turn, impact the entity's ability to offer VET FEE-HELP assistance to its students. While the Act does not detail maximum penalties for such breaches, the implications of losing approval could be significant for the entity's operations and reputation, as well as for its students' access to financial assistance for vocational education and training.
