Under section 2385 of the Act the Minister has delegated his powers under clauses 6 and 11 of Schedule 1A to the Act to an APS employee responsible for administering the Act.

Subclause 12(1) of Schedule 1A to the Act stipulates that a notice of approval under paragraph 11(1)(b) of the Act is a legislative instrument.

Purpose

This instrument:

Background

VET FEE-HELP is an income contingent loan scheme for the vocational education and training (VET) sector that is part of the Higher Education Loan Program (HELP).  It is an extension of the higher education FEEHELP arrangements.

VET FEE-HELP assists eligible students to pay for all or part of their VET tuition fees when studying one or more of the following eligible accredited VET courses of study: diploma; advanced diploma; graduate certificate; and graduate diploma.

In accordance with subclause 6(1) of Schedule 1A to the Act, bodies corporate that are also Registered Training Organisations (RTOs) are able to apply to become approved as a VET provider.  If approved, a VET provider will be able to offer VET FEE-HELP assistance to its eligible students.

Commencement

In accordance with subclause 12(2) of Schedule 1A to the Act and paragraph 12(1)(d) of the Legislative Instruments Act 2003, the notice and the decision to approve The Quest Group Pty Limited as a VET provider take effect on the day after the notice is registered on the Federal Register of Legislative Instruments.

Consultation

Consultation was not undertaken and was not considered necessary in this case because the notice confers a benefit on The Quest Group Pty Limited and this body is the only body affected by the notice.  This notice will not have a direct or substantial indirect effect on business, nor will it restrict competition.

Overview

The Higher Education Support Act 2003 was enacted to establish and regulate the Higher Education Support Scheme, which includes the VET FEE-HELP Assistance Scheme. The primary problem this legislation aimed to address was the need to provide financial assistance to eligible students in the vocational education and training sector, thereby making higher education more accessible. The Act was introduced by the Australian Parliament to facilitate this assistance through income contingent loans. The Explanatory Statement for the legislative instrument F2013L01948, issued under the authority of the Minister for Education, serves to approve The Quest Group Pty Limited as a VET Provider. This approval enables the provider to offer VET FEE-HELP assistance to its eligible students, thus extending the reach of the VET FEE-HELP Assistance Scheme. The policy objective is to ensure that eligible students have access to financial support for their vocational education and training, promoting educational equity and accessibility within the VET sector.

Scope and Application

This legislative instrument serves to approve The Quest Group Pty Limited as a VET provider under Schedule 1A of the Higher Education Support Act 2003. Specifically, it grants approval to The Quest Group Pty Limited, a body corporate and Registered Training Organisation, to participate in the VET FEE-HELP Assistance Scheme, which is an extension of the Higher Education Loan Program (HELP). By approving this entity, eligible students of The Quest Group Pty Limited can access income contingent loans for their vocational education and training fees. This approval is contingent on the Minister being satisfied that the applicant meets the stipulated criteria under the Act, and the decision is notified to the applicant in writing. The approval is effective from the day after the notice is registered on the Federal Register of Legislative Instruments. The instrument does not affect other entities or industries beyond The Quest Group Pty Limited and does not impose any significant restrictions on competition or business operations.

Key Provisions

The key operative sections of this legislation, specifically the F2013L01948 Notice of Approval, include subclause 6(1) and paragraph 11(1)(b) of Schedule 1A to the Higher Education Support Act 2003. Subclause 6(1) enables the Minister to approve bodies as VET Providers, while paragraph 11(1)(b) mandates that the Minister must notify applicants in writing of their approval status. The legislation also stipulates, under section 238-5, that the Minister has delegated his powers to an Australian Public Service (APS) employee responsible for administering the Act. Furthermore, subclause 12(1) clarifies that a notice of approval is a legislative instrument. In terms of obligations and requirements, the Act imposes on The Quest Group Pty Limited, as the approved VET Provider, the responsibility to adhere to the conditions set forth in the approval. This includes ensuring that the entity meets all the requirements necessary to provide vocational education and training (VET) courses eligible for VET FEE-HELP assistance. The entity must also comply with all applicable standards and regulations governing the provision of VET courses and the administration of the VET FEE-HELP scheme. Regarding offences, penalties, or consequences for breaches, the Act does not specify explicit criminal or civil penalties within this particular legislative instrument. However, non-compliance with the conditions of approval or failure to meet the standards and regulations governing VET courses and the VET FEE-HELP scheme could potentially lead to revocation of the approval, fines, or other administrative penalties. The severity of these consequences would depend on the nature and extent of the breach, as well as any relevant provisions in the Higher Education Support Act 2003 or other applicable legislation.
