Under section 238-5 of the Act the Minister has delegated his powers under clauses 6 and 11 of Schedule 1A to the Act to an APS employee responsible for administering the Act.

Subclause 12(1) Schedule 1A to the Act stipulates that a notice of approval under paragraph 11(1)(b) of the Act is a legislative instrument.

VET FEE-HELP is an income contingent loan scheme for the vocational education and training (VET) sector that is part of the Higher Education Loan Program (HELP).  It is an extension of the higher education FEEHELP arrangements.

VET FEE-HELP assists eligible students to pay for all or part of their VET tuition fees when studying one or more of the following eligible accredited VET courses of study: diploma; advanced diploma; graduate certificate; and graduate diploma.

In accordance with subclause 6(1A) of Schedule 1A to the Act, bodies of a kind established under the legislation listed at clause 2.2 of the VET Guidelines 2013 are able to apply to become approved as a VET provider.  In accordance with paragraph 2.2.1(c), Durack Institute of Technology, has been established by the State of Western Australia to provide vocational education and training under the Vocational Education and Training Act 1996 (WA).

Overview

The Higher Education Support Act 2003, enacted by the Parliament of Australia, aims to establish a robust framework for supporting higher education and vocational education and training in the country. This Act was introduced to address the need for regulated and quality-assured educational providers within these sectors, ensuring that students have access to support and that educational standards are maintained. One significant aspect of the Act is its provision for the approval of Vocational Education and Training (VET) providers, which is essential for facilitating the VET FEE-HELP Assistance Scheme. The policy objective underpinning this approval process is to ensure that eligible students can access financial assistance for their vocational education and training fees, thereby promoting wider participation in the VET sector. The explanatory statement for F2013L01935, issued under the authority of the Minister for Education, confirms the approval of the Durack Institute of Technology as a VET provider, enabling it to offer VET FEE-HELP assistance to its students, thereby extending educational opportunities and advancing the right to education.

Scope and Application

The F2013L01935 legislation, which is an approval and notice of approval under subclauses 6(1A) and 11(1) of Schedule 1A to the Higher Education Support Act 2003, concerns the approval of the Durack Institute of Technology as a VET provider. The Act applies to the Durack Institute of Technology, a body established under the Vocational Education and Training Act 1996 (WA), as the sole entity affected by the approval process. The Minister for Education has delegated the powers to approve and notify the Durack Institute of Technology under subclauses 6 and 11 of Schedule 1A to the Act to an APS employee responsible for administering the Act. This approval allows the Durack Institute of Technology to participate in the VET FEE-HELP Assistance Scheme, enabling eligible students to access financial assistance for accredited VET courses. The legislation has a Commonwealth jurisdictional reach as it is issued under the authority of the Minister for Education and is subject to the legislative framework of the Higher Education Support Act 2003. The approval and notification process outlined in the Act are governed by the requirements set forth in subclause 6(1A) of Schedule 1A to the Act, which ensures that the Durack Institute of Technology meets the necessary criteria to be recognised as a VET provider. The approval becomes effective on the day after the notice is registered on the Federal Register of Legislative Instruments. The notice of approval is a legislative instrument, and the process engages the right to education as stipulated in Article 13 of the International Covenant on Economic, Social, and Cultural Rights, promoting the availability of education and VET FEE-HELP assistance to eligible students.

Key Provisions

The key operative sections of the legislation (F2013L01935) under the Higher Education Support Act 2003 involve the approval and notification of the Durack Institute of Technology as a VET provider. Section 6(1A) of Schedule 1A allows the Minister to approve bodies as VET providers, and paragraph 11(1)(a) requires the Minister to decide on an application for approval. Furthermore, paragraph 11(1)(b) mandates that the applicant must be notified in writing of the decision. Section 238-5 of the Act delegates the Minister's approval powers to an APS employee, and subclause 12(1) specifies that the notice of approval is a legislative instrument. This instrument approves the Durack Institute of Technology as a VET provider, decides on its application, and notifies the Institute of this approval. The Act imposes several obligations and requirements on the Durack Institute of Technology. It must meet the criteria set out in subclause 6(1A) of Schedule 1A to gain approval as a VET provider. This includes being established under the Vocational Education and Training Act 1996 (WA) and being capable of offering eligible VET courses such as diplomas, advanced diplomas, graduate certificates, and graduate diplomas. Once approved, the Institute is authorised to offer VET FEE-HELP assistance to its eligible students. The approval process also includes a written notification of the decision to the Institute, ensuring transparency and legal certainty. The legislation includes provisions for offences, penalties, and consequences for breaches. While the explanatory statement does not detail specific penalties, breaches of the Higher Education Support Act 2003 can lead to civil or criminal consequences depending on the severity of the breach. For example, non-compliance with the VET FEE-HELP Assistance Scheme could result in financial penalties or legal action against the Institute. The maximum penalties for breaches are determined by the specific provisions of the Act and could include fines or other sanctions. These measures ensure that VET providers adhere to the standards and requirements set by the legislation.
