Overview

The Higher Education Support Act 2003 (HESA) was enacted to provide a framework for the support of higher education and vocational education and training (VET) in Australia, including the establishment and regulation of VET providers. The Act aimed to address the need for a structured approach to the regulation and support of VET institutions, ensuring they met certain standards and could offer assistance schemes like VET FEE-HELP to eligible students. Enacted by the Parliament of Australia, the Act sought to promote accessible and affordable education by enabling the Minister for Education and Training to approve bodies as VET providers and impose conditions to ensure quality and compliance. The policy objective was to facilitate the delivery of quality vocational education and training while providing financial assistance to students through schemes such as VET FEE-HELP. This legislative framework ensures that approved VET providers can offer courses and support services that meet the standards set forth in the Act, thereby enhancing the availability and accessibility of vocational education for Australian students.

Scope and Application

The VET Provider Approval No. 6 of 2015, issued under the Higher Education Support Act 2003, applies to Global Training Institute Pty Ltd, a corporate entity that has applied to become an approved provider of vocational education and training (VET) under the Act. The legislation authorises the Minister for Education and Training to approve bodies as VET Providers, and this specific approval extends to Global Training Institute Pty Ltd, enabling it to offer VET FEE-HELP assistance to eligible students. The approval is subject to certain conditions that the Minister can impose or vary, which are detailed in the Notice of Approval. The approval process is conducted under subclause 6(1) and paragraph 11(1) of Schedule 1A to the Act, with the Minister delegating these powers to an APS employee. The approval is effective from the day after the notice is registered on the Federal Register of Legislative Instruments. There were no consultations deemed necessary for this approval as it does not significantly affect business or competition, and the approval confers a direct benefit only to Global Training Institute Pty Ltd. This legislative instrument aligns with human rights by engaging the right to education, facilitating access to VET FEE-HELP assistance for eligible students at the approved entity.

Key Provisions

The main operative sections of this legislation, F2015L00501, include subclause 6(1) and paragraph 11(1) of Schedule 1A to the Higher Education Support Act 2003 (the Act), which provide for the approval of bodies as Vocational Education and Training (VET) Providers by the Minister, and require the Minister to notify the applicant in writing of the approval decision. Under section 238-5 of the Act, the Minister has delegated the powers under clauses 6 and 11 of Schedule 1A to an Australian Public Service (APS) employee responsible for administering the Act. Subclause 12(1) of Schedule 1A to the Act stipulates that a notice of approval is a legislative instrument. This specific instrument approves Global Training Institute Pty Ltd as a VET Provider, imposes conditions on its approval, decides the application for approval, and notifies Global Training Institute Pty Ltd of the approval. The obligations and requirements imposed by the Act on Global Training Institute Pty Ltd as a VET Provider include adhering to the conditions set by the Minister under clause 12A of Schedule 1A. These conditions are detailed in the Notice of Approval. The Minister has the authority to suspend or revoke Global Training Institute Pty Ltd's approval if it breaches any of these conditions, as per subclauses 33(1) and 36(1) of Schedule 1A. The approval and the accompanying conditions are intended to ensure that the VET Provider meets certain standards and criteria necessary for participating in the VET FEE-HELP Assistance Scheme. In terms of offences, penalties, or consequences for breach, the legislation stipulates that Global Training Institute Pty Ltd's approval as a VET Provider can be suspended or revoked if it fails to comply with the imposed conditions. The decision to suspend or revoke approval is made under subclauses 33(1) and 36(1) of Schedule 1A to the Act. The maximum penalties or specific consequences for breaches of these conditions are not explicitly stated in the provided text, but the Act implies that non-compliance could result in the loss of approval and the inability to offer VET FEE-HELP assistance to eligible students. The legal and financial implications of such a revocation would likely depend on the severity and nature of the breach.
