Overview

The Higher Education Support Act 2003, enacted by the Parliament of Australia, addresses the need for a regulatory framework governing the provision of financial assistance and support for students in higher education and vocational education and training sectors. This Act provides a comprehensive structure for managing the Higher Education Loan Program (HELP), including the VET FEE-HELP scheme, which assists eligible students with their tuition fees. In 2013, an instrument was issued under the authority of the Minister for Higher Education, approving Australian College of Commerce & Management Pty Ltd as a VET Provider. This approval enables the institution to offer VET FEE-HELP assistance to its students for eligible VET courses, thus enhancing access to vocational education and training. The policy objective is to facilitate student access to financial assistance, ensuring that educational opportunities are available to those who meet the eligibility criteria.

Scope and Application

The legislation, identified as F2013L01847, pertains specifically to the approval of Australian College of Commerce & Management Pty Ltd as a VET Provider under subclause 6(1) and paragraph 11(1) of Schedule 1A to the Higher Education Support Act 2003. This approval enables the entity to offer VET FEE-HELP assistance to its eligible students who are enrolled in accredited courses such as diploma, advanced diploma, graduate certificate, and graduate diploma. The Minister for Higher Education, exercising powers delegated under the Act, has approved this entity as a VET Provider, which is effective upon registration on the Federal Register of Legislative Instruments. The approval process ensures that Australian College of Commerce & Management Pty Ltd meets the stipulated requirements to provide vocational education and training and thus participate in the VET FEE-HELP scheme. The approval and subsequent notice are legislative instruments under subclause 12(1) of Schedule 1A to the Act, and no consultation was deemed necessary as the impact is limited to the approved entity alone.

Key Provisions

The legislation, F2013L01847, primarily focuses on the approval of Australian College of Commerce & Management Pty Ltd (ACCM) as a VET Provider under subclause 6(1) of Schedule 1A to the Higher Education Support Act 2003 (the Act). This approval is crucial for ACCM to be eligible to offer VET FEE-HELP assistance to its students. The Minister, under subclause 6(1) and paragraph 11(1)(b) of Schedule 1A to the Act, has the authority to decide on the approval of VET Providers and must notify the applicant in writing of the outcome. In this case, the Minister has approved ACCM as a VET Provider and has notified ACCM of this decision in writing. This approval takes effect on the day after the notice is registered on the Federal Register of Legislative Instruments, as stipulated by subclause 12(2) of Schedule 1A to the Act. The Act imposes specific obligations on ACCM as a newly approved VET Provider. ACCM must adhere to the standards and requirements set forth by the Act to maintain its approval status. This includes ensuring that it meets the criteria for VET FEE-HELP assistance, which involves offering eligible VET courses such as diplomas, advanced diplomas, graduate certificates, and graduate diplomas. ACCM must also comply with any additional conditions or requirements imposed by the Minister to ensure that it continues to meet the standards necessary for approval as a VET Provider. Failure to comply with the provisions of the Act could result in severe consequences for ACCM. The Act provides for both civil and criminal penalties for breaches, although the specific penalties are not detailed in this legislation. In general, breaches of the Act could lead to the revocation of ACCM's approval as a VET Provider, which would significantly impact its ability to offer VET FEE-HELP assistance to its students. Additionally, ACCM could face legal action, including fines and other sanctions, depending on the nature and severity of the breach. The exact penalties would be determined based on the specific provisions of the Act and any relevant case law.
