Overview

The VET Provider Approval No. 54 of 2013 is an instrument issued under the Higher Education Support Act 2003. The legislation was enacted to facilitate the establishment of a framework that supports vocational education and training (VET) in Australia, addressing the need for a structured and regulated system for VET providers to ensure quality education and training services. This instrument specifically approves M W Training Consultants Pty Ltd as trustee for The Morgan-Williams Family Trust as a VET Provider, enabling it to offer VET FEE-HELP assistance to eligible students. The purpose of this approval is to extend the availability of education by allowing eligible students to access financial support for their vocational courses. The approval process is overseen by the Minister for Education, who delegates the authority to an Australian Public Service employee responsible for administering the Act. This legislative instrument is compatible with human rights, particularly the right to education, by extending the availability of vocational education and training to eligible students through the approval of M W Training Consultants Pty Ltd as a VET provider.

Scope and Application

The legislation F2013L01820 pertains to the approval of a specific entity, M W Training Consultants Pty Ltd as trustee for The Morgan-Williams Family Trust, as a VET provider under Schedule 1A of the Higher Education Support Act 2003. The approval process is conducted by the Minister for Education and involves ensuring that the applicant meets the criteria set forth in subclause 6(1) of the Act, which mandates that the body must be a Registered Training Organisation (RTO) to qualify for approval. This legislative instrument is part of the broader VET FEE-HELP scheme, which is designed to assist eligible students in paying for their vocational education and training (VET) tuition fees. The approval not only recognises M W Training Consultants Pty Ltd as a legitimate provider of VET courses but also authorises it to offer financial assistance to eligible students through the VET FEE-HELP scheme. The approval takes effect on the day following its registration on the Federal Register of Legislative Instruments, as stipulated by subclause 12(2) of Schedule 1A to the Act. The legislation does not apply to any other entities except the specifically named M W Training Consultants Pty Ltd as trustee for The Morgan-Williams Family Trust, and its impact is limited to enhancing educational opportunities for eligible students by facilitating access to financial assistance for VET courses.

Key Provisions

The key operative sections of the F2013L01820 legislation involve the approval of bodies as VET Providers under subclauses 6(1) and 11(1) of Schedule 1A to the Higher Education Support Act 2003. Specifically, subclause 6(1) provides for the approval of bodies as VET Providers by the Minister, while paragraph 11(1)(b) mandates that the Minister must notify the applicant in writing of the decision regarding their approval as a VET Provider. The instrument also includes the formal approval and notification of M W Training Consultants Pty Ltd as trustee for The Morgan-Williams Family Trust as a VET Provider, which takes effect once the notice is registered on the Federal Register of Legislative Instruments. The obligations and requirements imposed by the Act on the parties it governs include meeting the criteria set out in subclause 6(1) of Schedule 1A to be approved as a VET Provider. This involves ensuring compliance with all relevant regulations and standards for vocational education and training. The Minister, or the delegate, must assess the application and determine whether the applicant meets the necessary requirements for approval. Additionally, the approved VET Provider must comply with ongoing obligations such as maintaining the quality of education provided and ensuring that they adhere to any changes in legislation or policy that may affect their status as a VET Provider. In terms of potential offences, penalties, or consequences for breach, the Act does not explicitly detail these within the explanatory statement. However, breaches of the conditions of approval or failure to comply with the ongoing obligations could lead to revocation of the approval, which would prevent the entity from offering VET FEE-HELP assistance. Such revocation would likely be communicated in writing and could result in significant operational disruptions for the VET Provider. While the explanatory statement does not specify maximum penalties, it is reasonable to infer that continued non-compliance or serious breaches could result in further legal actions or sanctions as prescribed by the Higher Education Support Act 2003.
