Overview

The Higher Education Support Act 2003 (the Act) was enacted to provide support for students and providers in the higher education and vocational education and training sectors, including the establishment of the VET FEE-HELP Assistance Scheme. The Act was introduced to address the need for a structured and regulated framework to support vocational education and training providers and ensure the availability of financial assistance to eligible students. The Act was enacted by the Australian Parliament. This legislation allows for the approval of vocational education and training (VET) providers and includes provisions for the Minister for Education to delegate approval and notification responsibilities to an appropriate employee. The explanatory statement for legislative instrument F2013L01818 clarifies that the Minister has exercised this delegation. The purpose of this specific legislative instrument is to approve West Coast Institute of Training as a VET provider, enabling it to offer VET FEE-HELP assistance to its eligible students. The instrument is compatible with human rights, specifically promoting the right to education by enabling eligible students to access VET FEE-HELP assistance.

Scope and Application

The legislative instrument F2013L01818, issued under the Higher Education Support Act 2003, pertains to the approval and notification of West Coast Institute of Training as a VET provider, allowing it to participate in the VET FEE-HELP Assistance Scheme. This scheme is designed to assist eligible students in paying for their vocational education and training (VET) tuition fees through income contingent loans. The Act applies to entities such as West Coast Institute of Training that have been established under state legislation and seek to provide vocational education and training. The approval and notification process is conducted under subclauses 6(1A) and 11(1) of Schedule 1A to the Act, with the Minister for Education having delegated these powers to an APS employee responsible for administering the Act. The approval and notification are effective from the day after the notice is registered on the Federal Register of Legislative Instruments. This legislative instrument does not apply to any other entities besides West Coast Institute of Training, and no consultation was deemed necessary as it solely benefits the named entity without affecting competition or business operations. Additionally, the instrument is compatible with human rights, specifically promoting the right to education by enabling eligible students of West Coast Institute of Training to access VET FEE-HELP assistance.

Key Provisions

The main operative sections of the legislation involve the approval of West Coast Institute of Training as a VET provider under subclause 6(1A) of Schedule 1A to the Higher Education Support Act 2003, the decision on the application under paragraph 11(1)(a) of Schedule 1A, and the notification of this decision under paragraph 11(1)(b). The Minister, through an authorised APS employee, has approved the Institute and notified it of its approval. This approval allows the Institute to offer VET FEE-HELP assistance to its eligible students, facilitating access to vocational education and training. The obligations and requirements imposed on the parties, particularly the Institute, include meeting the criteria set forth in subclause 6(1A) of Schedule 1A to the Act to qualify as a VET provider. This involves ensuring that the Institute is established under the relevant state legislation, in this case, the Vocational Education and Training Act 1996 (WA), and that it provides accredited courses such as diplomas, advanced diplomas, graduate certificates, and graduate diplomas. The Institute must also comply with any additional conditions or requirements specified by the Minister at the time of approval. There are no explicit offences, penalties, or civil/criminal consequences mentioned in the text for breach of the provisions in this legislation. However, failure to comply with the conditions of approval or to meet the criteria for VET FEE-HELP assistance could potentially lead to the revocation of the approval. This could be pursued under the general powers of the Minister to administer the Act and ensure compliance with the requirements for VET providers. While specific penalties are not outlined, such revocation could significantly impact the Institute's ability to offer VET FEE-HELP assistance to its students.
