Overview

The F2013L01779 legislative instrument, issued under the Higher Education Support Act 2003, pertains to the approval of Canterbury Business College Pty Ltd as a VET Provider. Enacted by the Australian Parliament, the Higher Education Support Act 2003 was designed to provide a legislative framework for the administration of financial support schemes for students in higher education and vocational education and training sectors. The Act aims to ensure the availability of financial assistance to eligible students, thereby promoting access to education and vocational training. The specific problem this legislative instrument addresses is the need to approve institutions as VET Providers to enable them to participate in the VET FEE-HELP Assistance Scheme, which supports students in paying for their vocational education and training tuition fees. The policy objective here is to facilitate the extension of financial assistance to eligible students by recognising and approving institutions that meet the necessary criteria.

Scope and Application

The legislative instrument F2013L01779 pertains to the approval and notice of approval for Canterbury Business College Pty Ltd as a VET Provider under subclauses 6(1) and 11(1) of Schedule 1A to the Higher Education Support Act 2003. The Act enables the Minister for Higher Education to approve bodies as VET Providers, which are entities capable of offering vocational education and training (VET) courses eligible for the VET FEE-HELP Assistance Scheme. This scheme is an income contingent loan mechanism to assist eligible students in paying their tuition fees. The approval process requires the Minister to be satisfied that the applicant meets the criteria set out in the Act. The Minister has delegated these powers to an Australian Public Service employee responsible for administering the Act. The approval and the subsequent notice of approval are legislative instruments that take effect the day after their registration on the Federal Register of Legislative Instruments. The approval specifically allows Canterbury Business College Pty Ltd to offer VET FEE-HELP assistance to its eligible students, thereby facilitating access to VET courses such as diplomas, advanced diplomas, graduate certificates, and graduate diplomas. The instrument also considers human rights compatibility, particularly the right to education as outlined in Article 13 of the International Covenant on Economic, Social, and Cultural Rights, by promoting educational access through the VET FEE-HELP Assistance Scheme.

Key Provisions

The main operative sections of this legislation are subclauses 6(1) and 11(1) of Schedule 1A to the Higher Education Support Act 2003 (the Act), which pertain to the approval of bodies as Vocational Education and Training (VET) Providers by the Minister for Higher Education. Subclause 6(1) specifies the criteria for approval, while paragraph 11(1)(a) mandates that the Minister must decide on applications for approval and paragraph 11(1)(b) requires the Minister to notify applicants in writing of the approval decision. Subclause 12(1) stipulates that the notice of approval is considered a legislative instrument. This particular legislative instrument approves Canterbury Business College Pty Ltd as a VET Provider and notifies them of the decision. The Act imposes certain obligations and requirements on parties governed by it, including that the Minister must be satisfied that the applicant meets the criteria set out in subclause 6(1) of Schedule 1A. This entails ensuring that the applicant is a body corporate and a Registered Training Organisation (RTO) to be eligible for approval. The Minister is also required to provide written notification of the decision to the applicant, as stipulated in paragraph 11(1)(b). This ensures transparency and provides the applicant with clear information regarding their approval status. In terms of offences, penalties, or consequences for breach, the legislation does not explicitly outline specific criminal or civil penalties for non-compliance with the approval process. However, failure to meet the criteria for approval or non-compliance with the requirements of the Act may result in the Minister declining the application for approval. Additionally, if a VET Provider engages in misconduct or fails to meet the standards set by the Act, they may face revocation of their approval status or other regulatory actions. It is important to note that the specific penalties for such actions would depend on the particular circumstances and any relevant provisions within the Act or related legislation.
