Overview

The Explanatory Statement details the approval and notice of approval under subclauses 6(1A) and 11(1) of Schedule 1A to the Higher Education Support Act 2003. Issued by the Minister for Higher Education, this legislative instrument approves The State of Queensland, as represented by Tropical North Queensland Institute of TAFE, as a VET provider. This approval enables the Institute to offer VET FEE-HELP assistance to its eligible students, thereby enhancing access to vocational education and training. The Minister, having delegated his powers under the Act, decided the application and notified the applicant of the approval, in accordance with section 238-5 and subclause 12(1) of Schedule 1A to the Act. The approval takes effect upon registration on the Federal Register of Legislative Instruments. The Higher Education Support Act 2003 was enacted to address the need for a structured support system for the vocational education and training sector. The purpose of this specific legislative instrument is to approve the Institute as a VET provider, ensuring eligible students can access financial assistance for their vocational courses. The approval aligns with the human right to education, promoting access to vocational training and thereby improving educational opportunities.

Scope and Application

The Higher Education Support Act 2003 applies to the approval and notification of Vocational Education and Training (VET) providers, including the State of Queensland as represented by the Tropical North Queensland Institute of TAFE, for the purposes of the VET FEE-HELP Assistance Scheme. This Act operates within the Commonwealth jurisdiction and provides for the Minister for Higher Education to delegate the powers to approve VET providers to an Australian Public Service employee. The approval process under subclause 6(1A) of Schedule 1A to the Act involves the Minister deciding an application for approval and notifying the applicant of the decision in writing. The approval takes effect on the day after the notice is registered on the Federal Register of Legislative Instruments. The Act does not specify any exclusions or exemptions for the approval of VET providers, and the scope of the approval is limited to entities that meet the requirements set out in the Act and associated guidelines. The application of the Act is further extended or restricted through subordinate instruments as necessary.

Key Provisions

The main operative sections of this legislation, specifically subclause 6(1A) and paragraph 11(1) of Schedule 1A to the Higher Education Support Act 2003 (the Act), provide for the approval of bodies as VET providers by the Minister and the notification of the applicant regarding the approval decision. Under section 238-5 of the Act, the Minister has delegated his powers under clauses 6 and 11 of Schedule 1A to an APS employee responsible for administering the Act. This particular legislative instrument approves The State of Queensland, represented by the Tropical North Queensland Institute of TAFE, as a VET provider under the Act, and notifies the applicant of this decision. The Act imposes certain obligations and requirements on the parties or entities it governs. Specifically, the Minister must be satisfied that the body meets the requirements of subclause 6(1A) of Schedule 1A to the Act to approve it as a VET provider. Additionally, the Minister must notify the applicant in writing of the approval decision under paragraph 11(1)(b) of the Act. Furthermore, a notice of approval is considered a legislative instrument under subclause 12(1) of Schedule 1A to the Act. This legislative instrument serves to approve The State of Queensland, represented by the Tropical North Queensland Institute of TAFE, as a VET provider for the purposes of the VET FEE-HELP Assistance Scheme under the Act. In terms of potential consequences for breach, the Act does not explicitly outline specific offences, penalties, or civil/criminal consequences for non-compliance with its provisions. However, it is important to note that the approval of a VET provider is contingent upon meeting the requirements set forth in subclause 6(1A) of Schedule 1A to the Act. Failure to meet these requirements could result in the denial of approval as a VET provider, which may limit the ability of the entity to offer VET FEE-HELP assistance to its eligible students. Additionally, the approval process and the obligations imposed by the Act are subject to scrutiny and review, which may lead to further consequences for non-compliance.
