Overview

The Higher Education Support Act 2003 was enacted to address the need for a robust framework governing financial assistance and support for students and providers in the higher education sector, including vocational education and training (VET). This legislation was introduced to ensure that eligible students have access to financial support to help cover their tuition fees, thereby facilitating broader educational access and participation. The Higher Education Support Act 2003 is administered by the Australian Parliament, with the Minister for Education responsible for its implementation. The policy objective of this legislation is to promote equitable access to higher education and VET by providing financial assistance to students and ensuring that institutions meet certain standards to participate in government-supported schemes such as VET FEE-HELP. This specific legislative instrument under the Act serves to approve Century Group Pty Ltd as a VET Provider, enabling them to offer VET FEE-HELP assistance to their eligible students, thereby furthering the Act's goal of supporting vocational education and training.

Scope and Application

This legislative instrument, F2014L00972, pertains to the Higher Education Support Act 2003 and concerns the approval of Century Group Pty Ltd as a VET Provider under subclause 6(1) of Schedule 1A of the Act. The Act applies to entities such as Century Group Pty Ltd, which are bodies corporate and Registered Training Organisations (RTOs) that wish to offer vocational education and training courses eligible for the VET FEE-HELP Assistance Scheme. This approval allows such entities to provide income contingent loans to their eligible students for tuition fees. The approval process and the consequential notice are governed by subclause 6(1), paragraph 11(1)(b), and subclause 12(1) of Schedule 1A to the Act, with the Minister delegating their powers to an APS employee for administering the Act. The approval takes effect on the day after the notice is registered on the Federal Register of Legislative Instruments, ensuring that Century Group Pty Ltd can commence offering VET FEE-HELP assistance to its students. The approval process engages the right to education, promoting access to vocational education and training for eligible students.

Key Provisions

The key operative sections of this legislation are subclause 6(1), paragraph 11(1)(b), and subclause 12(1) of Schedule 1A to the Higher Education Support Act 2003. Subclause 6(1) provides for the approval of bodies as VET providers by the Minister, paragraph 11(1)(b) mandates that the Minister must notify the applicant in writing of their approval or disapproval as a VET provider, and subclause 12(1) states that a notice of approval is a legislative instrument (6(1), 11(1)(b), 12(1)). The purpose of this legislation is to approve Century Group Pty Ltd as a VET provider under the VET FEE-HELP Assistance Scheme, enabling it to offer VET FEE-HELP assistance to its eligible students (Purpose). The obligations and requirements imposed by the Act on Century Group Pty Ltd, once approved, include the ability to offer VET FEE-HELP assistance to its eligible students for VET courses of study such as diploma, advanced diploma, graduate certificate, and graduate diploma (Background). The legislation imposes specific obligations on Century Group Pty Ltd, once approved as a VET provider. The primary obligation is to offer VET FEE-HELP assistance to eligible students who are enrolled in VET courses of study (Background). This includes providing financial assistance to cover all or part of their tuition fees, in line with the provisions of the VET FEE-HELP Assistance Scheme under the Higher Education Support Act 2003. The legislation also requires Century Group Pty Ltd to comply with all relevant regulations and standards set by the Australian Government for VET providers, ensuring that the quality of education and training provided meets the necessary criteria. Additionally, Century Group Pty Ltd must maintain accurate records of student enrolments and the disbursement of VET FEE-HELP funds, as well as report any discrepancies or issues to the relevant authorities. There are no specific offences, penalties, or civil/criminal consequences outlined in this legislation for Century Group Pty Ltd. However, failure to comply with the obligations and requirements imposed by the Higher Education Support Act 2003 and the VET FEE-HELP Assistance Scheme may result in the revocation of their approval as a VET provider. This could lead to the loss of eligibility to offer VET FEE-HELP assistance to students, which could significantly impact the institution's ability to operate and provide education and training services. Furthermore, non-compliance with relevant regulations and standards may result in additional penalties or sanctions imposed by the Australian Government.
