VET Provider Approval No. 42 of 2013

Issued by the authority of the Minister for Higher Education

Authority

Subclause 6(1) of Schedule 1A to the Higher Education Support Act 2003 (the Act) provides for the approval of bodies as VET Providers by the Minister. Paragraph 11(1)(a) of Schedule 1A to the Act provides that the Minister must decide an application for approval as a VET Provider and under paragraph 11(1)(b) cause the applicant to be notified in writing whether or not the applicant is approved as a VET provider.

Under section 2385 of the Act the Minister has delegated his powers under clauses 6 and 11 of Schedule 1A to the Act to an APS employee responsible for administering the Act.

Subclause 12(1) of Schedule 1A to the Act stipulates that a notice of approval under paragraph 11(1)(b) of the Act is a legislative instrument.

Purpose

This instrument:

a. approves Edith Cowan University (ABN: 54 361 485 361) as a VET Provider under subclause 6(1) of Schedule 1A to the Act;

b. decides the application of Edith Cowan University for the purposes of paragraph 11(1)(a) of Schedule 1A to the Act; and

c. gives Edith Cowan University notice of that approval for the purposes of paragraph 11(1)(b) of Schedule 1A to the Act.

Background

VET FEE-HELP is an income contingent loan scheme for the vocational education and training (VET) sector that is part of the Higher Education Loan Program (HELP).  It is an extension of the higher education FEEHELP arrangements.

VET FEE-HELP assists eligible students to pay for all or part of their VET tuition fees when studying one or more of the following eligible accredited VET courses of study: diploma; advanced diploma; graduate certificate; and graduate diploma.

In accordance with subclause 6(1) of Schedule 1A to the Act, bodies corporate that are also Registered Training Organisations (RTOs) are able to apply to become approved as a VET provider.  If approved, a VET provider will be able to offer VET FEE-HELP assistance to its eligible students.

Commencement

In accordance with subclause 12(2) of Schedule 1A to the Act and paragraph 12(1)(d) of the Legislative Instruments Act 2003, the notice and the decision to approve Edith Cowan University as a VET provider take effect on the day after the notice is registered on the Federal Register of Legislative Instruments.

Consultation

Consultation was not undertaken and was not considered necessary in this case because the notice confers a benefit on Edith Cowan University and this body is the only body affected by the notice.  This notice will not have a direct or substantial indirect effect on business, nor will it restrict competition.

Overview

The Higher Education Support Act 2003, enacted by the Parliament of Australia, addresses the need for a structured and supportive framework for vocational education and training (VET) in the country. The Act provides a comprehensive approach to funding, support, and quality assurance in the VET sector, ensuring that institutions meet certain standards to provide educational services. One significant aspect of the Act is the establishment of a VET FEE-HELP scheme, which offers financial assistance to eligible students studying specific accredited VET courses. The problem it aimed to address was the need for accessible and affordable vocational education, particularly for courses such as diplomas, advanced diplomas, graduate certificates, and graduate diplomas. The policy objective was to enhance the quality and availability of VET by ensuring that only suitably qualified providers could offer courses eligible for VET FEE-HELP assistance. The Act empowers the Minister for Higher Education to approve bodies as VET providers, ensuring that they meet the necessary criteria to participate in the scheme and provide quality education.

Scope and Application

The F2013L01673 Approval and Notice of Approval under subclauses 6(1) and 11(1) of Schedule 1A to the Higher Education Support Act 2003 pertains specifically to the approval of bodies as Vocational Education and Training (VET) providers under the auspices of the Australian Commonwealth. This legislation applies to Edith Cowan University, a body corporate and a Registered Training Organisation (RTO), and is enacted to facilitate its approval as a VET provider under subclause 6(1) of Schedule 1A to the Act. The approval allows Edith Cowan University to offer VET FEE-HELP assistance to its eligible students for accredited VET courses such as diplomas, advanced diplomas, graduate certificates, and graduate diplomas. The Act's application is confined to the vocational education sector and is executed by the Minister for Higher Education, who has delegated certain powers to an authorised Australian Public Service (APS) employee. The notice of approval constitutes a legislative instrument and takes effect upon registration on the Federal Register of Legislative Instruments. The legislation does not apply to any other entities except the specified RTO in this case, and no consultation was deemed necessary as it does not affect business or competition.

Key Provisions

The primary operative sections of this legislation, F2013L01673, involve the approval of Edith Cowan University as a VET Provider under subclause 6(1) of Schedule 1A to the Higher Education Support Act 2003 (the Act) and the subsequent notification of this approval under paragraph 11(1)(b) of Schedule 1A (subclause 12(1)). The Minister for Higher Education, having delegated this responsibility to an APS employee, has approved Edith Cowan University as a VET Provider, thus enabling it to offer VET FEE-HELP assistance to its eligible students. The Act imposes several obligations and requirements on Edith Cowan University once it is approved as a VET Provider. These include adherence to the VET FEE-HELP Assistance Scheme's criteria, ensuring that it offers eligible courses of study, and maintaining the standards set by the Higher Education Support Act 2003. The university must also ensure that its students meet the eligibility requirements for VET FEE-HELP assistance. In terms of potential offences, penalties, or consequences for breach, the legislation does not explicitly outline specific civil or criminal penalties for failing to comply with the Act's provisions. However, non-compliance could result in the revocation of the university's VET Provider status, which would prevent it from offering VET FEE-HELP assistance to its students. The Act provides for the Minister to take such actions if necessary, ensuring that the scheme's integrity is maintained and that only eligible students and institutions benefit from the VET FEE-HELP program.
