Overview

The Higher Education Support Act 2003 (the Act) was enacted to address the need for a structured approach to the provision of financial support to students in the vocational education and training (VET) sector. The Act, administered by the Parliament of Australia, aims to ensure that students have access to affordable education and training through mechanisms such as the VET FEE-HELP Assistance Scheme. This legislative instrument, VET Provider Approval No. 4 of 2013, issued by the Minister for Tertiary Education, Skills, Science and Research, serves to approve The State of Queensland, represented by Brisbane North Institute of TAFE, as a VET provider. This approval is pivotal in enabling eligible students to access financial assistance for their vocational education and training courses, thereby promoting the right to education. The Minister's decision and subsequent notice of approval under the Act facilitate the extension of VET FEE-HELP assistance, ensuring that students can afford their education without undue financial burden.

Scope and Application

The explanatory statement outlines the approval of The State of Queensland as represented by Brisbane North Institute of TAFE as a VET provider under subclause 6(1A) of Schedule 1A to the Higher Education Support Act 2003. This approval allows the institute to participate in the VET FEE-HELP Assistance Scheme, which is part of the Higher Education Loan Program (HELP) and provides income contingent loans for vocational education and training. The approval process involves a decision by the Minister for Tertiary Education, Skills, Science and Research, who has delegated this responsibility to the General Manager of the Student Support Branch in the Tertiary Quality and Student Support Division of the Department of Industry, Innovation, Science, Research and Tertiary Education. The approval and subsequent notification to the applicant are legislative instruments under the Act, taking effect the day after registration on the Federal Register of Legislative Instruments. This legislative instrument ensures that Brisbane North Institute of TAFE meets the criteria for being a VET provider, thereby enabling eligible students to access financial assistance for vocational education and training courses such as diplomas, advanced diplomas, graduate certificates, and graduate diplomas.

Key Provisions

The primary sections of the legislation (subclauses 6(1A) and 11(1) of Schedule 1A to the Higher Education Support Act 2003) provide for the approval of bodies as VET providers by the Minister. According to subclause 6(1A), the Minister must approve a body as a VET provider if they are satisfied that the body meets the specified requirements. Paragraph 11(1)(a) mandates that the Minister must decide on an application for approval, and under paragraph 11(1)(b), the Minister must notify the applicant in writing of their approval status. The authority to make these decisions and notifications has been delegated by the Minister to the General Manager of the Student Support Branch in the Tertiary Quality and Student Support Division of the Department of Industry, Innovation, Science, Research and Tertiary Education (section 238-5 of the Act). The Act imposes several obligations on the Minister and the entities it governs. The Minister must ensure that any body approved as a VET provider meets the requirements outlined in subclause 6(1A) of Schedule 1A. Once an application is decided, the Minister must provide written notification of the approval status to the applicant (subclause 11(1)(b)). Furthermore, the approval and notification process must be documented as a legislative instrument (subclause 12(1)). The State of Queensland, represented by the Brisbane North Institute of TAFE in this case, must meet the criteria for approval, which includes being established under the Vocational Education, Training and Employment Act 2000 (Qld). There are no explicit offences, penalties, or consequences for breach mentioned within the text. However, the approval process is critical as it determines a provider's eligibility to participate in the VET FEE-HELP Assistance Scheme, which offers financial assistance to eligible students for their vocational education and training fees. Failure to meet the criteria for approval could result in the application being rejected, thereby preventing the entity from offering VET FEE-HELP assistance to its students. The legislative instrument is designed to ensure that only entities meeting the necessary standards are approved, thus maintaining the integrity and effectiveness of the VET FEE-HELP scheme.
