Overview

The Higher Education Support Act 2003, enacted by the Parliament of Australia, serves to provide financial assistance to eligible students for vocational education and training courses. This legislation, through Schedule 1A, establishes the framework for the approval of VET (Vocational Education and Training) providers, including the criteria and process for such approvals. The enactment aimed to address the gap in providing a streamlined and regulated system for the delivery of VET FEE-HELP, ensuring that only qualified entities could offer this assistance. The Minister for Higher Education, acting under the authority delegated by the Act, issues approvals and notifications regarding VET providers. The policy objective is to facilitate access to vocational education and training by ensuring that only entities meeting specific standards can participate in the VET FEE-HELP scheme.

Scope and Application

The legislative instrument under consideration pertains to the approval of Smart City Vocational College Pty. Ltd. as a VET provider under the Higher Education Support Act 2003. This approval enables the college to participate in the VET FEE-HELP Assistance Scheme, offering income-contingent loans to eligible students for vocational education and training courses such as diplomas, advanced diplomas, graduate certificates, and graduate diplomas. The approval process is governed by subclauses 6(1) and 11(1) of Schedule 1A to the Act, where the Minister is responsible for determining the eligibility and subsequently notifying the applicant of the decision. The powers of the Minister have been delegated to an appropriate Australian Public Service employee for administration purposes. The approval, once notified in writing, becomes effective on the registration of the notice on the Federal Register of Legislative Instruments. The approval is a legislative instrument under the Legislative Instruments Act 2003 and aligns with the human rights framework, specifically the right to education outlined in the International Covenant on Economic, Social and Cultural Rights, by enabling eligible students to access financial assistance for their vocational education and training.

Key Provisions

The main operative sections of this legislation, F2013L01424, include subclause 6(1) and paragraph 11(1) of Schedule 1A to the Higher Education Support Act 2003. Subclause 6(1) allows the Minister to approve bodies as VET providers, while paragraph 11(1) mandates the Minister to decide on applications for such approval and notify the applicants of the decision. Specifically, this legislation approves Smart City Vocational College Pty. Ltd. as a VET provider under subclause 6(1) and notifies the college of this approval under paragraph 11(1)(b). This approval means the college can now offer VET FEE-HELP assistance to its eligible students. The obligations imposed by the Act on Smart City Vocational College Pty. Ltd. include meeting the criteria set out in subclause 6(1) of Schedule 1A for approval as a VET provider. This entails ensuring that the college meets all regulatory requirements for Registered Training Organisations (RTOs) and is capable of offering eligible VET courses that qualify for VET FEE-HELP assistance. Additionally, the college must comply with any other conditions or requirements imposed by the Minister as part of the approval process. The legislation does not explicitly outline specific offences, penalties, or consequences for breaches. However, failure to comply with the conditions of approval or any regulatory requirements could potentially lead to the revocation of the VET provider approval. Such revocation would disqualify the college from offering VET FEE-HELP assistance, impacting its students' ability to access financial assistance for their vocational education and training. Moreover, ongoing non-compliance might subject the college to further scrutiny or legal action under the Higher Education Support Act 2003 or other relevant legislation.
