Overview

The Explanatory Statement for Approval and Notice of Approval under subclauses 6(1) and 11(1) of Schedule 1A to the Higher Education Support Act 2003, VETP Approval No. 25 of 2014, details the process of approving Batchelor Institute of Indigenous Tertiary Education as a VET Provider. Issued under the authority of the Minister for Education, the legislative instrument is intended to formalise the approval process as stipulated in the Act. The Minister's powers under clauses 6 and 11 of Schedule 1A have been delegated to an APS employee, and the approval of Batchelor Institute as a VET Provider is contingent upon meeting the criteria outlined in subclause 6(1) of Schedule 1A. The purpose of the legislative instrument is to not only approve Batchelor Institute as a VET Provider but also to notify the applicant of the decision, ensuring transparency and adherence to the legislative framework. The legislative instrument addresses the need for streamlined approval processes for bodies seeking to provide vocational education and training (VET) under the VET FEE-HELP Assistance Scheme. By approving Batchelor Institute, the Act facilitates the extension of financial assistance to eligible students, promoting access to vocational education. The approval process is designed to ensure that only bodies meeting the requisite standards are able to participate in the scheme, thereby safeguarding the integrity and efficacy of the VET FEE-HELP program.

Scope and Application

The VET Provider Approval No. 25 of 2014, issued under the Higher Education Support Act 2003, pertains specifically to the approval of the Batchelor Institute of Indigenous Tertiary Education as a Vocational Education and Training (VET) Provider. This approval allows the Institute to participate in the VET FEE-HELP Assistance Scheme, which is part of the Higher Education Loan Program. The Act applies to bodies corporate that are also Registered Training Organisations (RTOs) and seeks to ensure that these entities meet certain criteria to offer VET FEE-HELP assistance to eligible students. The approval process involves the Minister for Education, who has delegated the decision-making authority to an Australian Public Service employee responsible for administering the Act. The approval is effective from the day after the notice is registered on the Federal Register of Legislative Instruments, thus establishing the Institute's eligibility to offer VET FEE-HELP assistance for courses such as diplomas, advanced diplomas, graduate certificates, and graduate diplomas. This legislative instrument ensures that eligible students at Batchelor Institute of Indigenous Tertiary Education can access financial assistance for their vocational education and training, thereby promoting the right to education.

Key Provisions

The key provisions of this legislation (F2014L00504) pertain to the approval of the Batchelor Institute of Indigenous Tertiary Education (ABN: 32 039 179 166) as a Vocational Education and Training (VET) Provider under subclause 6(1) of Schedule 1A to the Higher Education Support Act 2003 (the Act). The approval process is outlined in subclauses 6(1) and 11(1) of Schedule 1A, which mandates that the Minister for Education must decide an application for approval as a VET Provider and notify the applicant in writing of the decision (paragraph 11(1)(a) and (b) of Schedule 1A). This authority has been delegated by the Minister to an Australian Public Service (APS) employee responsible for administering the Act (section 238-5 of the Act). The notice of approval is considered a legislative instrument under subclause 12(1) of Schedule 1A. The approval of Batchelor Institute of Indigenous Tertiary Education as a VET Provider imposes certain obligations and requirements on the Institute. It must meet the criteria set out in subclause 6(1) of Schedule 1A to be eligible for approval. Once approved, the Institute is authorised to offer VET FEE-HELP assistance to its eligible students for courses such as diplomas, advanced diplomas, graduate certificates, and graduate diplomas. The Institute must comply with the conditions and standards applicable to VET Providers under the Act and ensure that it adheres to the requirements for offering VET FEE-HELP assistance to its students. The legislation also addresses potential breaches and associated penalties. While the explanatory statement does not explicitly detail specific offences or penalties, any failure to comply with the conditions of approval as a VET Provider could result in regulatory action, including the potential revocation of approval. Such revocation could have significant implications for the Institute’s ability to offer VET FEE-HELP assistance and its standing as a Registered Training Organisation (RTO). The consequences of non-compliance could also extend to legal action under the Act or related legislation, potentially leading to fines or other penalties as prescribed by law. It is crucial for the Institute to maintain compliance to avoid any adverse legal or financial repercussions.
